Sec. 8. No person shall be eligible to the office of out-door Qualifications. City Physician who has not received a diploma from a respectable medical college, and unless such person shall have had at least three years' experience as a physician and a resident of the City of Detroit; and the assistant shall be possessed of a similar qualification. Sec. 9. All complaints against the City Physicians and assist- Complaints ant shall be made to the Poor Commission, who will, with the Board Physicians. of Health, investigate the same, and, if found necessary, report the result to the Common Council, with their opinion thereon.

Sec. 10. In case of the desired absence or inability, from any cause, of a City Physician or assistant, to attend to his duties, he shall, with the consent of the Board of Health, provide a competent Physician to fill his place: Provided, That if such absence is for a longer period than two weeks, the consent of the Common Council. must be obtained.

Sec. 11. In addition to the duties hereinbefore designated and Additional prescribed, the out-door City Physicians shall be Health Inspectors, and shall perform such other duties and comply with such other rules and regulations as may from time to time be prescribed by the Common Council, Board of Health, or the Poor Commission.

CHAPTER 12.

CONSTABLES.

(Approved February 27, 1894.)

Section 1. Every Constable elected by the people of the City of Detroit shall, while in the performance of the duties of his office, wear such official badge as may be provided for Constables of the badge. City of Detroit by the Common Council thereof, and numbered in accordance with the ward for which such Constable was elected. Said badge shall be provided with a pin or other fastening, and How obtained coat. Such badge shall be issued by and be the property of the City of Detroit, and shall be worn only by the Constable elected for such ward as is shown by the number of such badge.

Sec. 2. Any Constable failing to wear such badge as above provided, or who shall allow any person other than himself to wear of offense. such badge, shall be deemed guilty of a malfeasance in office and of a willful neglect of duty and may be removed from office therefor by the Mayor.

Sec. 3. No other person than a duly elected Constable of the City of Detroit shall wear the official badge as above provided for Constables or any imitation thereof. Any violation of the provisions of this section shall be punished by a fine not to exceed one hundred dollars and costs; the Court may make a further sentence that the offender may be imprisoned in the Detroit House of Correction until the payment thereof, for any period of time not exceeding six months.

CHAPTER 13.

Examination of candidates.

BOILER INSPECTORS.

Section 1. There shall be an Inspector of Steam Boilers in and for the City of Detroit, who shall be appointed in the following

manner:

The Common Council shall provide for the fair and impartial examination of candidates for such inspectorship and for his assistants by three examiners, each an impartial and recognized authority in the construction and operation of steam boilers, and a resident of Detroit. These examiners shall be appointed at the request of the Common Council by the Department of Engineering of the University of Michigan. Said examiners may, if they see fit, call in said department to assist in said examination. Such examination shall cover such practical and theoretical matters as may come within the requirements specified by this ordinance for said Inspector. The Examiners shall report to the Common Council the name of the candidate deemed from said examination to be the most competent and eligible for said position. And the Common. Council shall thereupon appoint him to the same. Any person to be eligible for said examination must be of good character and temperate habits, a citizen of the United States and a resident of Detroit for not less than five years next preceding the date of examination. And otherwise conforming in his qualifications to the further requirements of this ordinance.

Sec. 2. The Boiler Inspector must be a man of skill, having had at least 10 years' actual experience in the operation of steam. boilers and whose knowledge of the construction and operation of steam boilers will enable him to conclusively determine whether every boiler inspected by him or his assistants complies with this ordinance and the rules embodied herein, and can be operated without danger to life and property. His term of office shall begin on the date of his appointment by the Common Council and shall con

tinue for a period of five years from the date of said appointment, or until his successor has qualified in accordance with the conditions of this ordinance. The salary to be paid to said Boiler Inspector shall begin on the date when he shall have accepted the appointment by the Common Council and duly qualified himself for said position in accordance with the terms of this ordinance. Before entering upon his duties he shall give bond in some guarantee insurance company acceptable to the Common Council in the sum of $5,000.00 for the faithful performance of his duties. The City of Detroit shall indemnify the Inspector, as well as his assistants, for the actual cost of the guarantee bond required of them under this ordinance, not to exceed the sum of $75.00 each.

Sec. 3. There shall be a First Assistant Boiler Inspector and Assistants. such other assistants as the Common Council and the Board of Estimates shall provide from time to time, one of whom at least shall be a boilermaker. Said First Assistant Boiler Inspector and all other assistants shall be selected in the manner and at the same time and shall take the same examination as provided for the selection of the Boiler Inspector. The examiners shall report to the Common Council the name of the next person deemed at said examination to be the most competent and eligible after the person selected for Boiler Inspector, for First Assistant Boiler Inspector. The examiners shall also report the names of a sufficient number of persons in order of their standing at said examination to provide for any and all other assistants allowed by the Board of Estimates. At least one assistant inspector shall be a competent and practical boilermaker of not less than 10 years' experience in such trade. The examiners shall give a separate examination to the boilermakers desiring to be appointed Assistant Boiler Inspector, which examination shall consist of questions relating to boiler inspection and construction. The examiners shall report to the Common Council the name of the candidate deemed from such examination to be the most competent and eligible for such position and the Common Council shall thereupon appoint him to same. Vacancies in the office of Boiler Inspector or Assistant Boiler Inspectors shall be filled by appointment by the Common Council upon recommendation of an examining board as provided for the original examination in Section 1 of this ordinance. The First Assistant Boiler Inspector and the Assistant Boiler Inspectors shall enter upon their respective duties and shall be paid the salary as provided by this ordinance when they have duly qualified and taken the proper oath to faithfully perform all duties of their offices. Their services shall continue for a period of five years from date of appointment by the Common Council, or until their successors shall be appointed and duly qualified, unless removed by the Common Council as provided in Section 24 of this ordinance. Each of the Assistant Boiler Inspectors shall give a bond in some guarantee insurance company in the sum of $5,000.00 each, acceptable to the Common Council for the faithful performance of their respective duties.

Sec. 4. The Boiler Inspector may appoint one clerk.

Sec. 5. The salary of the Boiler Inspector shall be $1,800 per annum, payable monthly. The salary of each of the Assistant Inspectors shall be $1,100 per annum, payable monthly. The salary of the Clerk shall be $1,034 per annum, payable monthly.

Before entering upon their respective duties they shall take a solemn oath to perform their duties faithfully and impartially without prejudice and favor, and under no circumstances shall they accept any money, gifts or other valuable consideration from any steam user or manufacturer of engine or boiler supplies or be directly interested in the manufacture of any boiler or engine, or boiler or engine supplies of any character or recommend any particular appliance or supplies relating to the operation of steam boilers or engines, during their term of office. Intemperance, indifference or negligence in the performance of their duties or any failure to comply with the spirit of this ordinance shall be sufficient cause for the dismissal of any person employed under the terms of this ordinance.

Sec. 6. There shall be provided by the Common Council one or more rooms to be occupied by the Boiler Inspector and Assistant Boiler Inspectors as an office.

Sec. 7. There shall be provided by the Common Council suitable books for records, blank forms and certificates and such other stationery as may be necessary for the proper transaction of the business of the office.

Sec. 8. The Boiler Inspector shall furnish, free of cost, a printed blank upon which notice is given the Boiler Inspection Department of the intention of making installation of any type of portable or stationary steam boiler, tank or jacketed kettle by any steam user. Boilers installed for heating purposes in private residences and cast iron sectional boilers installed for heating in buildings used for business purposes shall be exempt from the provisions of this section and from inspection except upon written request of the owner or occupant of the premises. The Boiler Inspector, upon written notice, will make an inspection of boilers in private residences and business places as above described, charging the rate provided in Section 11 of this ordinance. A private residence is any building occupied as a dwelling by not more than two families.

Sec. 9. The Boiler Inspector or the Assistant Boiler Inspectors shall make one internal and one external inspection of each boiler, except as noted in Section 8 of this ordinance, in the City of Detroit each year. If the Boiler Inspector deems it necessary to apply the hydrostatic test to a boiler it shall be done at the time of making the internal inspection, and the maximum hydrostatic

pressure applied to any boiler shall not exceed one and one-half
times the allowable working steam pressure of said boiler. After
applying the hydrostatic pressure test to any boiler the Boiler In-
spector shall cause the water to be drained out of the said boiler
and immediately thereafter a thorough internal inspection of said
boiler shall be made by said Boiler Inspector.

The City Boiler Inspector shall upon the written request of any owner or steam user, make the annual internal boiler inspection at the same time with the boiler insurance companies.

The City Boiler Inspector may make hydrostatic tests in conjunction with the boiler insurance companies. Whenever the boiler insurance companies benefit by the labor of the city inspectors the City Boiler Inspector shall make a charge of $1.50 against the insurance companies benefiting by the labor of the city inspectors.

Sec. 10. A complete record of each inspection shall be kept Record by the Boiler Inspector in books of record provided for the purpose, giving in detail the result of the inspection, including the kind of boiler, kind and quality of material, thickness of plates, dimensions of the boiler, particulars as to riveting, including size and spacing of rivets, and whether the seams are single, double, triple or quadruple riveting, results of calculations made by the Boiler Inspector as to the steam pressure safe to be carried on said boiler, condition of the setting, feed water apparatus, age of the boiler, date of inspection, and any other particulars that the Boiler Inspector may deem pertinent. A manifold copy of this record shall be supplied with the certificates of inspection. After having made an inspection the Boiler Inspector shall number each boiler and issue an inspection certificate therefor. Every certificate issued by the Boiler Inspector shall indicate the kind, size, number and location of the boiler covered by it and the maximum steam pressure under which the boiler safely may be operated. All inspection certificates must be inclosed in a dust-proof frame and be prominently displayed in the boiler or engine room and as near as convenient to the boilers to which they refer. The frame for inclosing certificates of inspection must be supplied by the owner of the boilers. Provided, that only one certificate of inspection may be issued for all boilers carrying the same pressure in any one boiler-room, which certificate shall clearly indicate the total number of boilers covered by it.

Sec. 11. The Boiler Inspector shall make a total charge for Charge. inspection of each and every boiler of three dollars ($3.00), which charge shall include both the internal and external inspections, and which money shall be paid by the user of the boiler to the City Treasurer upon receipt of certificate and report of the results of the inspections. All strictly religious and charitable institutions shall be exempt from inspection charges.
