Sec. 19. Fuel sheds covering an area not exceeding one hun- Fuel sheds. dred and fifty square feet within the fire limits may be constructed of wood, provided that no such shed shall have a height of more than ten feet from the ground, and shall be covered with slate, tile, metal or composition and gravel roofing: And, provided further, That no such shed shall be placed within the distance of ten feet of any part of any other building, and that not more than one such shed shall be erected upon the same lot or premises.

Sec. 20. When any wooden building within the fire limits shall be partially destroyed by fire or other causes, or shall become decayed and the damage by said fire or other destructive causes or the cost of repairing such decayed part of any building shall not, in the opinion of the Fire Marshal, exceed one-half of its actual value, such building may be repaired, and not otherwise: Provided, That in any such last mentioned case the Fire Marshal may require, as a condition of issuing the permit heretofore provided for, that the shingle or other wooden roof of such building be replaced by a roof made of slate, gravel or other non-combustible material.

Sec. 21. In estimating the value of any building partially destroyed by fire or other cause, the sum of money it would cost to estimated. build the same new from the bottom of the sills shall be the basis of estimating value, and in estimating the damage to such building the same shall be assumed to be the sum of money required to restore such building to the condition in which it was before its partial destruction.

Sec. 22. No person shall remove or cause to be removed any Removal of building situated within the fire limits to another location in said limits so that any part of such building shall be within a distance. of 40 feet of any part of any other building then erected; Provided, That said building is not injured by fire or other cause or damaged to the extent of more than one-half of its value, to be determined by the Fire Commissioner. Sec. 23. No person shall hereafter locate or establish any yard Lumber yards. for the sale or storage of lumber, wood, bark, posts or other like material within the fire limits established by this ordinance.

Sec. 24. All buildings, of whatever description, hereafter erected or repaired in the city, shall be under the control and inspection of the Fire Marshal in so far as may be necessary to secure greater safety from destruction by fire; and to this end it shall be the duty of any person desiring to build, or repair any building, to apply for Permit. a permit from the Fire Marshal, and to follow such reasonable directions as the said Fire Marshal may give as to the size and location of chimneys, the size of all flues, the protection of furnaces, heating pipes and all other arrangements desired to be used in heating such building, or in creating heat for mechanical or manufacturing purposes.

Sec. 25. For each and every week in which a building erected, placed, removed or repaired, contrary to the provisions of this ordinance, shall be allowed to remain, the owner of such building may be complained of as a distinct offense, and punished as hereafter provided.

Sec. 26. No person shall use or occupy, within the limits of the City of Detroit, any building for the manufacture of turpentine, camphene, fireworks, or other dangerous or easily inflammable or explosive substances, or for the storage of gunpowder in larger quantities than twenty-eight pounds, or for the storage of fireworks of any description whatever.

Sec. 27. No person shall have, put, or keep any hay, straw, cotton, hemp, or wood-shavings, in stack or pile, without having the same securely inclosed, so as to protect them from flying sparks of fire. And no person shall have or place in any stove grate or furnace, or use in lighting or kindling fires in any private house, store, hotel, shop or other building, any kerosene, gasoline, benzine, naphtha, or other highly explosive or inflammable substance.

Sec. 28. No lighted candle or lamp shall be used in any stable, building, or other place where hay, straw, hemp, cotton, flax, bushes, shavings, gunpowder, or other combustible materials shall be stored or lodged, unless the same is well secured in a lantern.

Sec. 29. Repealed March 5, 1912.

Sec. 30. No person shall carry fire in or through any street, alley or lot in this city, unless the same be placed in some covered pan or vessel.

Sec. 31. No ashes shall be kept or deposited in any part of this city, except the same be kept or deposited in a close iron, tin or earthen vessel, or brick or stone ash house, thoroughly secured.

Sec. 32. No person except as herein provided shall kindle any fire or furnish material for any fire to be made or kindled in any street, alley or public place within the city unless by tinners, plumbers or other mechanics in pursuing a business requiring the use of a fire or for the purpose of boiling tar, pitch or oil to be used in the construction or repair of some building or vessel; Provided, That said fire shall be made in some crate or vessel so that the same shall not emit sparks or otherwise endanger surrounding property. This ordinance shall not apply to a person of suitable age who shall burn under his control and his presence loose waste paper in mesh receptables, the mesh of which shall be of a size not larger than two by three inches. No occupant of any premises shall permit accumulation of such waste paper of more than two weeks' duration. (Approved July 23, 1912.)

Sec. 34. There shall not be kept in any house, or its appur- Gunpowder. tenances within the limits of the city, except in a magazine, to be approved by the Fire Marshal, at any one time, more than twentyeight pounds of gunpowder, which shall be secured in metal canisters, with metal stoppers or covers. Any gunpowder kept contrary to this section shall be seized by the Fire Marshal, and on conviction, before the Recorder's Court, of the party so keeping the same, it shall be forfeited to the use and benefit of the city, to be sold under the direction of the Mayor, and the offender shall be punished as hereinafter provided.

Sec. 38. FIREARMS AND FIREWORKS.

(Approved January 13, 1890.)

Section 1. No person except an officer in the discharge of his duty or a citizen in self-defense, shall draw, handle or flourish a revolver, pistol, or gun in any public street, avenue or lane, public park or other public space, or in any alley in the City of Detroit.

Sec. 2. No person under the age of sixteen years shall bear or have upon his person while in or upon any of the public or private places aforesaid any revolver or pistol.

Sec. 3. No person shall fire or set off any squib, cracker, gunpowder or fireworks, or fire any gun, revolver, pistol, toy pistol, cap or cartridge of any kind in any street, lane, alley or other public space, or in any yard, public or private place within said city: Provided, however, that the Mayor, by a general order or proclamation, may grant permission to all persons within the city to use fireworks on the fourth day of July in each year, under such limitations and restrictions as he may deem proper; provided, further, however, that nothing in this ordinance shall be construed to permit the firing of any kind of fireworks on the fourth day of July. within a distance of 300 feet of any hospital at any time on said day, nor to the use of pistols, revolvers, toy cannons or dynamite crackers, so called, at any time on said day, nor to the use of any kind of fireworks to be set off on street railway tracks either by concussion or by the passing of street cars, nor to the placing on said tracks of any such fireworks or explosives. Sec. 3. (a) No person, firm or corporation shall exhibit or have in possession, with intent to give away or sell, or offer for sale or sell within the city limits, any dynamite preparation, or any toy pistol (except cap pistol), toy cannon or dynamite cannon or dynamite cracker whatsoever, or any other cracker exceeding in length five inches, or any cane or other appliance designed to be used in connection with the explosion of the foregoing articles. (Approved December 12, 1905.)

Sec. 4. CHAPTER 200.

PROHIBITING SALE OF BLANK CARTRIDGES, ETC.

Section 1. That hereafter it shall be unlawful for any person or persons, firm or corporation to sell or offer for sale or to use in the City of Detroit any blank cartridges, blank cartridge pistols, toy cannons, toy pistols, firecrackers of any size loaded with dynamite or any other high explosive, potash and sulphur tablets or pellets, cane ammunition or canes used for exploding same, or any firecracker exceeding three inches in length by one-half inch in diameter.

Sec. 2. Hereafter it shall be unlawful for any person or persons at any time within the City of Detroit to place on the rail of any street railway or steam railroad any cap, cracker or other explosive ingredient with the intent that it be discharged and exploded by the passage of any street car or steam car or other vehicle over the same.
