§ 114. § 2. Section one hundred and sixteen of title two of chapter three of part four of the revised statutes, as amended by chapter three hundred and eighty-two of the laws of eighteen hundred and eighty-nine, added thereto by chapter three hundred and ninety-five of the laws of eighteen hundred and ninety, relating to state prisons, is hereby amended so as to read as follows:

S ents of any of the penal institutions in this state, to hereafter receive or permit to be received therein, any prisoner convicted in the United States courts, held without the state of New York, or in any state other than that of the state of New York. It shall be lawful for the agents and wardens of the state prisons, and the managers of the reformatories of the state to receive prisoners convicted and sentenced in the United States courts in this state, for one year or more, upon proper contracts made for their care and custody, to be approved by the superintendent of state prisons; but no prisoners sentenced in United States courts in this state, for one year or more, shall be received in any penal institution in this state, except in the state prisons and reformatories as aforesaid.

§ 3. Section three of chapter three hundred and eighty-two of the laws of eighteen hundred and eighty-nine, entitled "An act to amend title two of chapter three of part four of the revised statutes relating to state prisons, and for other purposes connected therewith," is hereby amended so as to read as follows:

Chap. 430.

AN ACT to amend chapter ten hundred and twenty-six of the laws of eighteen hundred and ninety-five, to provide for the appointment of a state commission of prisons, and defining its duties and powers.

BECAME a law May 4, 1896, with the approval of the Governor. Passed, three-fifths being present.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. Section four of chapter ten hundred and twenty-six of the laws of eighteen hundred and ninety-five is hereby amended sc as to read as follows:

§ 4. The said commission shall annually elect one of its members as the president of the commission, and shall also annually elect a secretary, who shall keep a record of all its proceedings, and perform such duties as may be required of him by the commission and by law, and he shall receive a salary of three thouEmployes sand dollars per annum; and the said commission may also appoint as employes and assistants of said commission, and of the commissioners, in the performance of their official duties, a clerk, at an annual salary of one thousand five hundred dollars, a stenographer and a general office assistant, at an annual salary of one thousand dollars each, and remove each and appoint a sucRules, etc. cessor at any time; and the said commission is authorized to make rules and regulations for its meetings and the transaction of its business and also as to the manner in which reports to it shall be made, and all matters shall be presented before it.

§ 2. Chapter ten hundred and twenty-six of the laws of eighteen hundred and ninety-five is also hereby amended by inserting therein, after section seven, a new section, to be numbered section seven-a, which shall read as follows:

§ 7a. The said commission shall have the further duty and au thority to require the proper officials of the state and the politi-t cal divisions thereof, and of all public institutions of the state, and political divisions thereof, supported wholly or in part by the state, or any political division thereof, to furnish to said commission, annually, estimates for each ensuing year of the amount of labor to be required by each, and of the articles which may be manufactured in penal institutions, required to be purchased for the use of the state or the political divisions, or said institutions in their charge or under their management.

§ 3. Section eight of said chapter ten hundred and twenty-six of the laws of eighteen hundred and ninety-five is hereby amended so as to read as follows, to wit:

§ 8. The said commissioners shall receive as compensation for Compen their time and services the sum of ten dollars per day for each peo commissioner for the time actually employed in attending regular meetings of the commission, and in the performance of all official duties by authority or direction of the commission. But in no event shall the total annual compensation of said commission exceed the sum of four thousand dollars. The actual expenses of each one of them while engaged in the performance of official duties shall be paid quarterly by the treasurer on the warrant of the comptroller, and the salary and expenses of the secretary and the other stated employes of the commission shall be paid monthly in like manner.

§ 4. This act shall take effect immediately.

wise appropriated, for continuing the work of constructing such portions of the capitol as the commissioners of the new capitol shall determine to have done by day's labor, and for the purpose of paying the expenses of supervision, inspection, clerk hire, and supplies necessary for continuing such work by day's labor and also for continuing the work by contract as provided in the suc ceeding section of this act. Such money shall be payable by the treasurer, on the warrant of the comptroller, on certificates of the commissioners of the new capitol, approved by the chairman and secretary of the capitol commission.

§ 2. The sum of five hundred thousand dollars, or so much thereof as may be necessary, is hereby appropriated out of any money in the treasury belonging to the general fund not other wise appropriated, for continuing the work on the capitol by contract or contracts as may be entered into by the capitol commissioners pursuant to the provisions of chapter seven hundred and thirty-seven of the laws of eighteen hundred and ninety-five. The said sum is appropriated for the purpose of paying any contractor or contractors for the estimated work to be performed by him or them prior to the first day of April, eighteen hundred and ninety-seven. And such money shall be payable by the treasurer on the warrant of the comptroller on certificates of the commissioners of the new capitol approved by the chairman and secretary of said commission.

§ 3. This act shall take effect immediately.

AN ACT in relation to a library for the appellate division of the supreme court for the third department.

Section 1. The sum of thirty thousand dollars, or so much Appropria thereof as may be necessary, is hereby appropriated out of any money in the treasury not otherwise appropriated, for the purpose of completing, furnishing and equipping the State Reformatory for Women, at Bedford, Westchester county. Such completion shall include within the eight buildings, all steam fittings and fixtures, woodwork in hard wood, two steam boilers and all ironwork. Also grading, drainage, sewerage, water supply for general and fire protection purposes; electric light and power plant for buildings and grounds, including wiring and fixtures, power apparatus for laundry, general store-house, all outside plumbing, gate-keeper's house, barn, retaining wall and fence to surround buildings, office and bed-room furniture, including furnishings for beds, ranges, crockery and kitchen utensils and farming implements.
