Amendment to

SECOND AMENDMENT.

There shall be an additional article to said constitution, to

be designated as article XII, as follows:

OF NEW COUNTIES.

No county shall be divided by a line cutting off over one-
tenth of its population, (either to form a new county or other-
wise,) without the express assent of such county, by a vote of
the electors thereof; nor shall any new county be established,
containing less than four hundred square miles.

THIRD AMENDMENT.

From section two of the first article of the constitution, strike
article I of the out the words, "of the city of Philadelphia, and of each county
respectively;" from section five, same article, strike out the
words, "of Philadelphia and of the several counties;" from sec-

no county shall be divided, in the formation of a district. Any
city containing a sufficient number of taxables to entitle it to at
least two representatives, shall have a separate representation
assigned it, and shall be divided into convenient districts of con-
tiguous territory, of equal taxable population as near as may be,
each of which districts shall elect one representative."

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the state treasurer be and he is hereby authorized to pay A. Certain money to W. Benedict, clerk of the house of representatives, the sum of twenty-five dollars, being the amount paid by him to Edward M'Pherson, for services rendered as the clerk to the committee of ways and means, in the investigation under the resolution of February fifteenth, one thousand eight hundred and fifty-five, and which was paid the said M'Pherson pursuant to the direction of a resolution of the house of representatives, passed March eighth, one thousand eight hundred and fifty-five.

AN ACT

Providing for the election of a Senator to represent this State in the Senate of the United States.

WHEREAS, A vacancy now exists in the representation from this state in the senate of the United States; therefore,

SECTION 1. Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly Election of U. S. met, and it is hereby enacted by the authority of the same, Thai the members of both houses shall meet in convention, in the chamber of the house of representatives, at the hour of twelve, on the second Monday of January, in the present year, and then and there proceed to choose a senator to represent this state in the senate of the United States, for the term of six years from the fourth day of March last, and that the candidates be nominated, and the election held and conducted in the manner prescribed by the act, entitled "An Act relating to the elections of this commonwealth," passed the second day of July, eighteen hundred and thirty-nine.

Repeal.

SECTION 2. That the supplement to the act named in the foregoing section, passed the eighteenth day of April, eighteen hundred and fifty-three, be and the same is hereby repealed.

Be it enacted by the Senate and House of Represen tatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the provisions of the eighteenth section of the act, entitled "An Act regulating railroad companies," approved the nineteenth day of February, one thousand eight hundred and forty-nine, be and are hereby declared to be applicable to the railroads
