Mr. Temple moved that the notice of the contest in the matter of contesting the seat of Hon. W. H. Byers be read.

You are hereby notified that the undersigned, Geo. Battey, intends to contest the election held in Shelby county, Iowa, November 7, 1899. So far as the same relates to and affects the office of representative in the Twenty-eighth General Assembly of Iowa, from said county, to-wit, the Twenty-third Representative district, of said state, and therein to contest the correctness and validity of votes cast and received at said election, and the correctness and validity of the canvass of the returns of said election by precinct and county canvassers and the seating of yourself as "incumbent." All of said matters and things and grounds of contest are fully set out in exhibit "A," hereto attached and made part of this notice.

That in the said contest I shall claim that I am duly qualified to hold said office, having been duly and legally elected thereto and should be seated in your place and stead.

Mr. M. L. Temple moved that the notice of contest and papers relating thereto be referred to a committee of seven. Carried.

Mr. Carr moved that a committee of five be appointed to act with a like committee from the Senate on inaugural ceremonies.

Carried.

Mr. McCurdy offered the following resolution and moved its adoption.

Resolved, That the House now proceed to the selection of seats in the following manner: A slip of paper containing the name of each member of the House, shall be placed in a box or hat by the tellers, and after being thoroughly shaken, the slips shall be drawn out one by one by the acting clerk at the desk, and handed to the tellers who shall announce the name so drawn, and the member whose name is drawn shall immediately select his seat and state to the tellers the number, and they shall make a record of the same, except that those having defect of hearing or sight may be allowed to choose seats first.

There being no objection to resolution it was adopted.

Mr. Hinkle moved that the House adjourn to 2 o'clock P. M.
Motion lost.

Mr. Kendall moved that ex-speakers be allowed to select their own seats.

Carried.

Resolved, That Joseph D. Wyatt be granted the privilege of keeping a bootblack chair in the cloak room of the House for the accommodation of members and employes of the House.

Mr. Prentis offered the following resolution and moved its adoption.

Resolved. That G. W. Nichols be allowed to place his barber chair in the cloak room for the present session!

On motion of Mr. Hawk, the House adjourned until 2.30 P. M.

AFTERNOON SESSION.

House met at 2 P. M. with Speaker Bowen in the chair. Mr. Overfield offered the following resolution and moved its adoption:

Resolved, That a committee of three (3) be appointed by the Speaker whose duty it shall be to fix amount of mileage due each member and report the same to the House.

Adopted.
