Mr. Dows moved that Senate file No. 18, which was a duplicate, be substituted for House file No. 19, and that the reading just had be considered the third reading of the bill.

Mr. Thueren requested that the Journal show that he would have voted aye, had he been present when the roll was called on Senate file No. 18.

Mr. Temple, from the committee on Judiciary, submitted the following report:

MR. SPEAKER-Your committee on Judiciary, to whom was referred House file No. 12, a bill for an act to amend section twenty-six hundred sixty-seven of the code, relating to the rate of interest to be charged in loaning the endowment funds of the State College of Agriculture and Mechanic Arts, beg leave to report that they have had the same under consideration and have instructed me to report the same back to the House with the recommendation that the same do pass.

Ordered passed on file.

Mr. Byers moved that the report of the committee be adopted and the bill placed upon the calendar.

Carried.

Mr. Dows asked for a reading of Joint resolution No. 4, recommending additional employes and fixing their compensation and the manner of payment thereof, which was read.

Mr. Dows thereupon moved that the rules be suspended, and the reading just had be considered the third reading, and the resolution put upon its passage.

Mr. Byers asked that the resolution be read again.

The resolution was read.

Mr. Dows' motion was voted upon and carried.

By Carr, House file No. 56, a bill for an act to authorize the improvement and regulate the use of Des Moines river and its bed and banks within the corporate limits of the city of Des Moines.

By Thuenen, House file No. 57, a bill for an act to amend section 720 of the code relating to gas works and electric light plants.

Read first and second time and referred to committee on Municipal Corporations.

By Myers, House file No. 58, a bill for an act to amend section 2992 of chapter 9, title 14 of the code of Iowa, relating to landlord and tenant.

Read first and second time and referred to committee on Judiciary.

The Journal of January 19th was corrected and approved. Mr. Wise offered the following resolution:

WHEREAS, The Hon. Edward Townsend, an honored member of the Twenty-second and Twenty-third General Assemblies, from Black Hawk county, also a member of the Iowa Soldiers' Monument commission, having closed life's work at his home in Cedar Falls, on the 19th instant, therefore be it

Resolved, That a committee of five be appointed to present resolutions commemorating his life and work.

Mr. Wright moved that the resolution be adopted.

Carried.
