AN ACT to amend "An act to incorporate the village of Cambridge," passed April sixteenth, eighteen hundred and sixty-six, and the several acts amendatory thereof.

PASSED May 9, 1870; three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

SECTION 1. Section three of an act entitled “An act to incorporate the village of Cambridge," passed April sixteenth, eighteen hundred and sixty-six, and the several acts amendatory thereof, is hereby amended so as to read as follows:

3. The officers of the said village shall be denominated village officers. The village officers shall be a president and six trustees, who shall reside within the territory of the said village, and three of whom shall reside in each road district, as provided in section one; a treasurer, two assessors, one in each road district; clerk, collector, two street commissioners, one in each road district; six police constables, three in each road district; a police justice, a pound-master and two fire wardens. The president, trustees, treasurer, assessors, police justice and collector, shall be elected by ballot at each annual meeting, and shall serve without fee or reward, except the police justice and collector, who shall severally be entitled to Appointive their fees, as hereinafter provided; all other officers named in this act shall be appointed annually by the board of trustees, and may be removed by the board of trustees for sufficient cause shown, but all such officers shall have a right to be heard in their own defense before said board, after they have been duly served with a copy of said Powers and charge. The said police justice and police constables shall have and are hereby vested with the same powers constables. and jurisdiction in all criminal proceedings arising in the bounds of said village, and in all actions for penalties arising under any of the provisions of this act, or under any of the by-laws of said village, and shall be entitled to the same fees for their services, and shall be paid in the same manner as is now provided by law for the jus

§ 2. Section eleven of said act is hereby amended so as to read as follows:

§3. Section eighteen of said act is hereby amended so as to read as follows:

They shall hire and employ the requisite laborers, and direct them as to the time and manner of the execution of their work, and shall certify from time to time to said board, when required by them, the names of all persons who shall have been employed by them, and the amount paid each person each day. They shall, within said village, possess the powers and perform the duties of overseers of highways, so far as such powers and duties are required to be performed therein, and are consistent with this act. They shall keep an accurate account of all moneys expended by them, and shall, at least ten days before the annual election, and at such other times as the board of trustees shall require, render to the said board a statement, under oath, setting forth the amount of work done and when and where done, the amount of money received and paid out, together with vouchers; and the street commissioners shall be entitled to receive for their services such sums as the trustees shall direct, to be paid out of the general highway fund. § 4. Section twenty-nine of said act is hereby amended so as to read as follows:

ments and names appear on the last assessment rolls of the several towns in which said village is located, and who are at the time residents of the said village, at the annual meeting for the election of village officers, or at any special meeting duly called specifying the object of said meeting, may, by the vote of a majority of the persons voting at such election, authorize the trustees to raise a sum by tax, not exceeding fifteen hundred dollars in any one year, over and above the highway tax, for making any improvements and for contingent expenses in said village, which a majority of the said trustees shall deem proper and necessary; and the said trustees shall apportion the sum to be raised upon the taxable property of said village as the same shall appear from the assessment roll made by the assessors of said village in each and every year. The assessors shall make their assessment roll for said village in each and every year as the same shall appear from the last assessment rolls of the towns of Cambridge, White Creek and Jackson; provided that said assessors, when property shall be found upon said roll or rolls situate partly without said village and partly within, shall deduct from said assessment the just proportion for that part of the assessed property lying without the bounds of said village, Completion as in their judgment shall be just and proper. And in case any building situate in said village shall be destroyed by fire or otherwise, or in case any building shall be erected or repaired in said village, or any real estate shall change owners after the completion of the assessment roll or rolls of said towns, and before completing the assessment roll of said village in each and every year, or in case any real estate or other property shall be omitted from the roll or rolls of said town assessors, then, and in either case, the said village assessors may deduct therefrom or add to their assessment rolls the proper names and valuation as, in their judgment, shall be just and equita ble. They shall perform said duties and complete said rolls between the first Tuesday and the twentieth day of May in each and every year, and shall give six days' notice of the completion of said rolls from said twentieth day of May, to review said assessment on the application of any person or persons claiming a reduction of their asDelivery to sessment; and shall deliver their rolls completed to the trustees of said village on or before the first day of June, in each and every year. § 6. This act shall take effect immediately.

AN ACT to improve and keep in repair the highway from Wilmington to North Elba, in the county of Essex.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

84. The commissioners of highways of the towns of Wilmington and North Elba shall annually assess thereon the usual highway taxes, in the same manner as such taxes are assessed and charged upon the lands in their respective towns, which taxes shall be paid to the commissioners under this act for the purpose of working and keeping in repair Supervisors said highway. All such highway taxes not paid to said commissioners previous to the annual meeting of the board of supervisors, shall be assessed and charged by the supervisors upon the assessment rolls of said towns of Wilmington and North Elba, and a sum equal to the From State admitted arrears of highway taxes assessed upon said lands, together with any sum that may be paid to the Comptroller or State Treasurer on account of the highway taxes on said lands, shall be paid annually to said commissioners on the order of any two of them, out of the treasury of this State, and the amount of said taxes so in arrears, or paid to the Comptroller for the year eighteen hundred and sixty-nine, shall be paid to the said commissioners in the manner above stated.

§ 5. If the officers, or any of them, whose duty it shall be to assess the highway taxes on any of the lands in said assess high- road district, or to perform any duty relating thereto, in district. shall neglect to assess such lands, or to perform their duties relating thereto, then said commissioners shall make the usual assessment of highway taxes, and return their assessment to the board of supervisors, who shall assess and charge the same on the rolls, as specified in sec
