§ 13. TITLE VII.

OF OFFICERS-THEIR POWERS AND DUTIES.

SECTION 1. It shall be the duty of the clerk of said village to keep all the books and papers belonging to said village; to attend all the meetings of the trustees; to keep a journal and record of the proceeding of said trustees at every meeting thereof; to record all by-laws, ordinances, rules and regulations, made and passed by said trustees; to receive, file and preserve all returns of the elections of village officers, and to record the same, all reports of the treasurer, all bonds of village officers, with the approvals thereof, all returns of votes taken on questions submitted to the electors and inhabitants of said village for approval or disapproval, and all other papers required to be filed by the provisions of this act, or by the direction of the trustees; 'to attend all elections of village officers, and at votings on any questions submitted as aforesaid, and to keep a poll-list of all persons voting at any such election, under the direction of the presiding officer; to put and post all notices in the manner and in the places prescribed and directed by this act, except those pertaining particularly to the office of assessor and street commissioner, or by any by laws or ordinances of said trustees;

to serve written notices of the election on all officers elected under this act as soon thereafter as may be; to keep an accurate account of all orders, and the amount thereof, drawn by said trustees on the treasurer, in an order book to be kept by him for that purpose; to keep the corporate seal of said village; and to perform all the duties required by this act, or by the trustees, or by the by-laws or ordinances of said village. 4. The street commissioner of each ward, upon missioners, receiving the ward roll provided in section four, title six of this act, shall forthwith give notice to all persons and corporations mentioned in said roll of the receipt of the same, and of the time and place in the ward for which said commissioner shall have been appointed where said persons and corporations may pay the tax therein levied and assessed against them, by posting notices thereof in at least three public places in said ward ten days before the time designated therein for receiving said taxes. Said notices shall also state that said commissioner will attend at the time and place therein specified, between the hours of nine o'clock in the forenoon and four o'clock in the afternoon, to receive said taxes; and it shall be the duty of said commissioner to so attend, and to receive all such taxes as shall be voluntarily paid him; but he shall not demand or receive any fee therefor, except as hereinafter provided.

§ 5. If any person or corporation upon whom such tax is imposed shall neglect or refuse to pay his, her or their said tax, at said time and place, it shall be the duty of said commissioner, within six days thereafter, or within such further time as said trustees shall permit, by resolution duly entered in the records of said village, to make complaint on oath to any justice of the peace of the town in which said village or any part thereof is situated, showing a full compliance with the provisions of the last preceding section by said commissioner, the default of said person or corporation, and the amount of the tax unpaid by them, or either of them, as the same shall appear in said ward roll.

6. The justice to whom such complaint shall be made shall forthwith issue a summons, directed to the police constable of said village, or to any constable of the county of Saratoga, requiring him to summon such delinquent to appear forthwith before such justice, at some place within the corporate limits of said village, to be specified in the summons, to show cause why he should not be fined according to law for such neglect or refusal; which summons shall be served personally, or by leaving a copy thereof at his personal abode; provided that, if such delinquent be a corporation, such summons may be

served by delivering a copy thereof to the president, or other head of the corporation, secretary, cashier, treasurer, superintendent, a director or managing agent of said corporation.

§ 10. Every fine received by said commissioners shall be set off against the tax of the person or corporation on whom such fine was imposed. § 11. 12. The street commissioner of each ward in said vil-
lage shall, on or before the tenth day of May in each and
every year, deliver to the assessor of said ward a list, sub-
scribed by him, containing the names of all the male
inhabitants of said ward of the age of twenty-one years
and upward.

13. Each street commissioner shall, at least fifteen days before the annual meeting in said village, return to trustees. his ward roll to the trustees thereof, and shall, at the same time, make return on oath to said trustees of the amount of taxes collected by virtue of said roll, the amount paid to the treasury, with his receipts therefor, the date of every order issued by said commissioner on the treasurer, the amount thereof, and to whom payable, and the amount of taxes unpaid and against whom assessed. Each of said commissioners shall be entitled to receive for his services such sum as the trustees shall direct, not exceeding two dollars per day for every day actually spent in the performance and discharge of his duties, as in this act provided, to be paid out of the highway tax; and said commissioners may, from time to time, present to allowed and said trustees an account in items of their said services up to the time of presenting the same, duly verified, which account, if correct, shall be indorsed "allowed" by said trustees, and subscribed by then, whereupon said commissioners may proceed to collect the amount thereof, as is provided in section eleven of this title.

$14. The collector of said village shall exercise and powers and perform all the powers and duties required of him by this act, and, in addition thereto, such other as may be prescribed by the trustees and not inconsistent with his office, and shall receive therefor the compensation herein before allowed.

15. The police constable shall have the same power. and authority, and be subject. to the same liabilities and powers and obligations, except as herein otherwise provided, as stables elected in any of the towns of Saratoga county. It shall be his duty to obey such orders as he may from time to time receive from the trustees of said village regarding his duty; to report to the president all violations of the corporation ordinances, by-laws, rules and regulations, with the names and residences of the witnesses; to preserve the public peace; to be vigilant for
