that the rents reserved in leases specified in said act, can be taxed for school and highway purposes.

On motion of Mr. Cole,

Resolved, That a respectful message be transmitted to the Assembly, requesting them to transmit to the Senate the petition of B. Fairman and others praying for the passage of a law for the construction, at the expense of the State, of a bridge across the Erie canal at Medina, in the county of Orleans, and the papers accompanying the same.

On motion of Mr. Frost,

Resolved, That the Assembly be requested to transmit to the Senate the papers and petition on file in relation to the claim of John Cammerdon for certain moneys for giving information of an escheat.

The Senate then resolved itself into a committee of the whole on the bill entitled, "An act to amend the 73d section of title 4, chapter 2, part 4 of the Revised Statutes," and after some time spent thereon, Mr. Cook, from said committee, reported progress, and asked for and obtained leave to sit again.

The Senate then resolved itself into a committee of the whole on the bill entitled, "An act in relation to pardons," and after some time spent thereon, Mr. W. Hall, from said committee, reported in favor of the passage of the same with amendments.

The President put the question whether the Senate would agree to the report of the committee, and it was decided in the affirmative, as follows:

Ordered, That said bill be engrossed for a third reading. The Senate then resolved itself into a committee of the whole on the bill entitled, "An act to exempt from execution the homestead of a householder having a family," and after some time spent thereon, Mr. Martin, from said committee, reported progress, and asked for and obtained leave to sit again.

The Senate then resolved itself into a committee of the whole on the bill entitled, "An act to amend the charter of the New-York Floating Dry Dock Company," and after some time spent thereon,

Mr. Williams, from said committee, reported progress, and asked for and obtained leave to sit again.

The Senate then resolved itself into a committee of the whole on the bill entitled, "An act authorising the trustees of the Regular Baptist Church and Society of the town of Eden, Erie county, to sell and dispose of their real estate and for other purposes," and after some time spent thereon, Mr. Clark, from said committee, reported in favor of the passage of the same.

Ordered, That the question on agreeing with the report of the committee of the whole be laid on the table.

The Senate then resolved itself into a committee of the whole on the engrossed bill from the Assembly entitled, "An act to provide for filling up the stock of the Fireman's Insurance Company in the city of Albany, and to reduce the number of its directors," and after some time spent thereon, Mr. W. Hall, from said committee, reported in favor of the passage of the same without amendment. Ordered, That said bill do have its third reading.

A bill was received from the Assembly for concurrence entitled, "An act to reduce the capital stock of the Albany Insurance Company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks and insurance companies.

A bill was received from the Assembly for concurrence entitled, "An act to authorise the Dexter, Brownville and Pamelia Plank Road Company to erect a toll gate on that part of their road now finished," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

A bill was received from the Assembly for concurrence entitled, "An act to authorise the clerk of the county of Erie to appoint a special deputy," which was read the first time, and by.unanimous consent was also read the second time, and referred to the committee on the judiciary.

A bill was received from the Assembly for concurrence entitled, "An act to confirm the title of the trustees of the First Baptist Church and Society of Newfane to certain lands," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on charitable and religious societies.

A bill was received from the Assembly for concurrence entitled, "An act to authorise the trustees of the village of Williamsburgh to raise money by loan to pay certain debts," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on cities and villages.

Mr. S. H. P. Hall, from the committee on engrossed bills, reported as correctly engrossed the bill entitled, "An act in relation to pardons."

In pursuance of previous notice,

Mr. Lawrence asked for and obtained leave to bring in a bill entitled, "An act to amend section 15, article 1, title 4, chapter 8,

part 3, of the Revised Statutes," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on banks and insurance companies.

And then the Senate adjourned till 11 o'clock to-morrow morning.

The Journal of yesterday was read and approved.

Mr. Bokee presented the memorial of Henry Wyllys Taylor of Canandaigua, against the abolition of the death penalty, which was ordered printed and referred to the committee of the whole when on the bill introduced by Mr. Coffin.

Mr. Martin presented the remonstrance of the trustees of the village of Jamestown against the repeal of the act to extend Third-st. in said village, with a map, which was referred to the committee on cities and villages.

Mr. Cole presented the petition of citizens of Orleans for a law authorising the supervisors of Orleans county to raise one thousand dollars by tax to build a bridge across Oak Orchard creek and to construct a road thereto, which was referred to the committee on roads and bridges.

Mr. Cole also presented the petition of Elias Wilcox for the passage of a law authorising the payment of damages sustained by him by reason of waters discharged from the Erie canal, which was referred to the committee on canals.

Mr. Smith, from the committee on roads and bridges, reported in favor of the passage of the bill from the Assembly entitled, "An act to authorise the Dexter, Brownville and Pamelia Plank Road Company to erect a toll gate on that part of their road now finished," which was committed to the committee of the whole.

Mr. Little from the committee on charitable and religious societies, reported in favor of the passage of the bill from the Assem bly entitled, "An act to confirm the title of the trustees of the First

Baptist Church and Society of New Fane to certain lands," which was committed to the committee of the whole.

Mr. S. H. P. Hall, from the committee on state prisons, reported in favor of the passage of the bill entitled, "An act in relation to the removal of convicts from one state prison to another," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Lawrence, from the committee on finance, reported adverse to the passage of the bill from the Assembly entitled, "An act to authorise the Comptroller to employ additional clerks for certain purposes, and making an appropriation for their payment," which was committed to the committee of the whole.

Mr. Williams, from the committee on claims, reported unfavorably on the petition of Calvin Christie for the reimbursement of moneys paid for taxes, with the following resolution :

Resolved, That the prayer of the petitioner be denied.

The President put the question upon agreeing to the resolution, and it was decided in the affirmative.

Mr. Wilkin, from the committee on the judiciary, reported in favor of the passage, with amendments, of the bill entitled, "An act for the appointment of referees in the city of New-York," which was committed to the committee of the whole.

Mr. Wilkin, from the committee on the judiciary, to which was referred the petition for that purpose, reported a bill entitled, "An act to effectuate letters patent heretofore issued to Mary Englishbee," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Wilkin, from the committee on the judiciary, to which was referred the petition for that purpose, reported a bill entitled, "An act to repeal two certain acts for the benefit and relief of Francis Englishbee," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Fine, from the committee on the judiciary, to which was referred a petition for that purpose, reported a bill entitled, "An act to change the name of Archibald Morrison Stowe to Archibald Morrison Morrison," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

On motion of Mr. Wilkin,

Resolved, That a committee be appointed on the "internal affairs of towns and counties," to be added to the standing committees of the Senate.

Ordered, That Messrs. Geddes, Colt and Tamblin be said committee.

Mr. Bokee gave notice that he would, at an early day, ask leave to introduce a bill in relation to the foreclosure of mortgages.

Mr. Whallon gave notice that he would, at some future day, ask leave to introduce a bill to repeal the act entitled, "An act concerning passengers arriving at the ports of entry and landings in this State."

Mr. Cole gave notice that he would, at an early day, ask leave to introduce a bill authorising the appraisal and payment of certain canal damages sustained by Ezra Wood; also a bill authorising the appraisal and payment of certain canal damages sustained by Elias Wilcox; also a bill authorising a loan from the common school fund to the county of Orleans for the purpose of building a bridge across the Oak Orchard creek in the town of Carlton in said county; also a bill authorising the Canal Commissioners to build a bridge across the Erie canal in the village of Medina.

In pursuance of previous notice,

Mr. Cole asked for and obtained leave to introduce a bill entitled, "An act to authorise the appraisal and payment of certain canal damages sustained by Ezra Wood," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on canals.
