competentemente para effeituarem o dito Tratado, em que interveio como Mediador e Garante Sua Magestade Britanica; e para este fim se apresentou com os necessarios Plenos Poderes Mr. William A'Court, Enviado Extraordinario, e Ministro Plenipotenciario da Corte de Londres.

ART. I. Haverá huma Paz firme, estavel, e perpetua entre as 2 Altas Partes Contractantes, e os seus respectivos Vassallos; e quaesquer Embarcações assim de Guerra, como Mercantes de ambas as Nações, poderão navegar livremente, e com toda a segurança, para onde bem lhes convier, levando para isso os correspondentes Passaportes.

II. Todas as Embarcações e Vassallos de Portugal poderão entrar, sahir, demorar-se, commerciar, e prover-se de todo o necessario nos Dominios de Argel, sem que se lhes ponha embaraço, ou se lhes faça alguma violencia. Os Vassallos e Embarcações Argelinas serão tratados da mesma sorte nos Dominios de Portugal.

III. As Embarcações de Guerra pertencentes á Coroa de Portugal poderão prover-se de todo o mantimento, ou de qualquer outra cousa de que precisarem nos Portos de Argel, e pelo preço corrente, sem que sejão obrigadas a pagar por isso mais cousa alguma.

IV. Nenhum Corsario Argelino poderá cruzar na distancia de 6 milhas das Costas de Portugal, e suas Ilhas, ou demorar-se naquelles sitios com o fim de dar cassa, ou

for which purpose Mr. Wm. A'Court, Envoy Extraordinary and Minister Plenipotentiary from the Court of London, presented himself with the necessary Powers.

ART. I. There shall be a firm, stable, and perpetual Peace between the 2 High Contracting Parties, and their respective Subjects; and all Vessels, whether of War or Commerce, may freely navigate, and with full security, according to their convenience, carrying with them for that purpose the necessary Passports.

II. All Ships and Subjects of Portugal may enter, depart, remain, trade, and provide themselves with every necessary in the Dominions of Algiers, without being placed under any embarrassment, or having any violence done them. The Subjects and Vessels of Algiers shall be treated in the same manner in the Dominions of Portugal.

III. The Ships of War belonging to the Crown of Portugal may provide themselves with stores, or anything they stand in need of in the Ports of Algiers, and at the current price, without being obliged to pay anything additional for that privilege.

IV. No Algerine Corsair shall cruise within the distance of 6 miles from the Coast of Portugal and its Isles, or remain in those waters for the purpose of giving

VI. Os Estrangeiros de qualquer Nação, e as fazendas de propriedade Estrangeira, que se encontrarem a bordo de qualquer Embarcação Portugueza, ainda mesmo de Nação inimiga de Argel, não poderão ser aprehendidas debaixo de pretexto algum, que se queira allegar. O mesmo se praticará da parte dos Portuguezes a respeito dos effeitos, que se encontrarem a bordo de qualquer Embarcação Argelina.

Da mesma sorte os Vassallos e Fazendas pertencentes a qualquer das Partes Contratantes, que se encontrarem a bordo de Embarcação Inimiga de qualquer das mesmas Partes Contratantes, serão respeitadas e postas em liberdade pela outra Parte; mas não poderão emprehender a sua viagem sem o correspondente Salvoconducto. Se acontecer porém que este se desencaminhe, nem por isso as ditas Pessoas serão reputadas Escravos; antes pelo contrario, certificando em como são Vassallos de qualquer das Altas Partes Contratantes, deverão ser

V. When any Portuguese Merchant Vessel is met by an Algerine Corsair, and the latter demands to visit her, he may do so; but not more than 2 Persons are to go on board the said Vessel, to examine her Papers and Passports.

VI. Foreigners of any Nation, and merchandise of Foreign ownership, which may be found on board any Portuguese Vessel, even though belonging to a Nation hostile to the Regency of Algiers, shall not be seized under any pretext whatever. The same rule shall be observed by the Portuguese, in regard to property which. may be found by them on board any Algerine Vessel.

In like manner the Subjects and Goods belonging to either of the Contracting Parties which may be found on board the Vessel of an Enemy of either of the said Contracting Parties, shall be respected and set at liberty by both. But they are not to commence their voyage without a proper Passport; and if that should happen to be mislaid, such Persons shall not on that account be considered as Slaves; but, on the contrary, upon its being certified that they are Subjects of either of the Contracting Parties, they shall be immediately set at liberty.

VII. Se algum Navio Portuguez, perseguido do Inimigo, se refugiar em algum dos Portos dos Dominios de Argel, ou debaixo das suas Fortalezas, os Habitantes defenderão o dito Navio, e não consentirão que se lhe faça prejuizo algum. Da mesma sorte se alguma Embarcação Portugueza se encontrar com Embarcação sua Inimiga nos Portos de Argel, e aquella quizer sahir para o seu destino, não se permittirá que a sua Inimiga levante do Porto senão 24 horas depois da sua partida. O mesmo se praticará nos Portos de Portugal com as Embarcações Argelinas.

VIII. Se alguma Embarcação Portugueza infelizmente naufragar, ou encalhar nas Costas dos Dominios de Argel, o Governador e Moradores daquelle Districto deverão tratar a Tripulação com toda a humanidade, não a prejudicando, nem permittindo, que se lhe roube cousa alguma; antes pelo contrario lhe prestarão todo o auxilio para poder salvar a dita Embarcação com a sua Carga, ou aquillo que lhe for possivel; não devendo ser obrigada a mesma Tripulação a pagar, senão o salario, ou jornal áquelles que nisso se tiverem empregado. A mesma consideração se terá com qualquer Embarcação Argelina, que infeliz. mente naufragar nas Costas de Portugal.

IX. Os Vassallos de Portugal poderão commerciar nos Portos e Estados de Argel do mesmo modo, e com as mesmas prerogativas,

VIII. Should any Portuguese Vessel unfortunately be shipwrecked or stranded on the Algerine Coast, the Governor and Inhabitants of the District shall treat the Crew with due bumanity, doing them no harm, nor permitting them to be robbed; on the contrary, they shall afford them all possible assistance in saving the said Ship and Cargo; the Crew not being bound to pay anything to such Salvors but their salary or day's wages. The same shall hold with regard to any Algerine Vessel which may unfortunately be wrecked on the Portuguese Coast.

IX. The Subjects of Portugal may trade in the Algerine Ports in the same manner, paying the same Duties, and enjoying the

O mesmo Consul poderá julgar todas as contendas e questões suscitadas entre os Vassallos Portuguezes, sem que nisso se possão intrometter os Juizes da Terra, ou alguma outra Authoridade; salvo se a questão for entre Portuguez e Mouro, porque nesse caso a deverá julgar o Governador da Terra na presença do mesmo Consul.

XI. O referido Consul e seus Encarregados não poderão ser obrigados a pagar divida alguma contrahida por Vassallos Portuguezes; excepto no caso de se terem obrigado a ello por escripto feito de sua letra e sigual,

XII. Se algum Portuguez fal lecer nos Dominios de Argel, todos os seus bens se entregarão ao Consul de Portugal, para serem por elle remettidos aos Herdeiros do dito defunto.

XIII. Succedendo qualquer contravenção ao presente Tratado da parte dos Vassallos de Portugal, ou dos Vassallos de Argel, nem por isso se dissolverá o

X. The Portuguese Consul, established in the Dominions of Algiers, shall be considered and treated like the British Consul; and he, as well as his servants, and all others who may wish to practise it, shall enjoy the free exercise of their religion in his own house. The same Consul may decide all controversies and disputes arising among Portuguese Subjects, without the Judges of the Country, or any other Authority, being entitled to interfere; except where a controversy arises between a Portuguese and a Moor, in which case the Governor of the Country may decide it, in the presence of the said Consul.

XI. The said Consul and his Agents shall not be bound to pay any debt contracted by Portuguese Subjects, unless where he has bound himself by writing under his hand and seal.

XII. When any Portuguese dies in the Dominions of Algiers, all his property shall be delivered to the Portuguese Consul, in order to be remitted to the Heirs of the deceased.

XIII. Should there happen any infraction of the present Treaty on the part of the Subjects of Portugal, or those of Algiers, the present Treaty of Peace between

Neste intervallo poderão o Consul de Portugal e todos os Vassallos do mesmo Reino retirarem-se com todos os seus bens; assim como os Vassallos Argelinos, que estiverem em Portugal, para o paiz; sem que se lhes possa pôr o menor embaraço.

XV. Tudo o mais não expeci ficado nos precedentes Artigos será regulado pelos Artigos de Paz estabelecida entre Sua Magestade Britanica e a Regencia de Argel.

XVI. E para que seja firme e duravel este Tratado acceitão as 2 Altas Partes Contractantes por Medianeiro e Fiador da sua observancia o Rei de Grã-Bretanha; em prova do que o assigna Mr. A'Court, Enviado Extraordinario e Ministro Plenipotenciario da Corte de Londres, juntamente com os mencionados Enviados de Portugal, e deste se extrahirão 2 Copias, huma para o Soberano do dito Reino de Portugal, e outra para ficar em poder do seu Consul residente em Argel.

the 2 Nations shall not on that account be considered as dissolved ; but the origin of such circumstance shall be examined into, and proper satisfaction given to the injured Party.

XIV. In case of War being declared between the 2 High Contracting Parties (which God avert), hostilities shall not be committed on either side till the the expiration of 6 months after the said Declaration. During that interval the Portuguese Consul, and all Subjects of that Kingdom, may retire with all their property, without receiving the least hinderance; and Algerine Subjects in Portugal may do the same, without impediment.

XV. Whatever is not specified in the above Articles shall be regulated by the Articles of Peace established between His Britannic Majesty and the Regency of Algiers.

XVI. And that this Treaty may be firm and durable, the 2 High Contracting Parties accept as Mediator and Guarantee of its observance the King of Great Britain in testimony of which this Treaty is signed by Mr. A'Court, Envoy Extraordinary from the Court of London, jointly with the above-mentioned Envoys of Portugal; and 2 Copies of the same shall be extracted, oue for the Sovereign of Portugal, and the other to remain in the possession of the resident Consul at Algiers.
