1. ELECTRICITY 16(7)—WIRES ACCESSIBLE TO BOYS-NEGLIGENCE.

Electric companies stretching wires through trees which children can climb must anticipate their presence in such trees, and where a boy climbed from a building into a tree, and a twig broke and he fell against electric company's uninsulated wires and was injured, the company was liable.

2. ELECTRICITY 15(1) WIRES-TRESPASSER.

INJURIES FROM

Where a boy, playing, upon a building be longing to another party by owner's sufferance, climbed upon a tree either on such party's premises or in an alley, and while there was injured by defendant's uninsulated wires, such boy was not a trespasser as to defendant.

3. ELECTRICITY 18(1)-INJURIES FROM CURRENT-CONTRIBUTORY NEGLIGENCE.

Where plaintiff, a boy, climbed into a tree and slipped or fell, from the breaking of a twig, against defendant's uninsulated wires passing through the tree, and there was no evidence that he knew of the defect of the insulation or that he purposely touched the wires, contributory negligence is not shown.

4. APPEAL AND ERROR-882(12) INVITED ERROR-INSTRUCTIONS.

Criticism of matter in an instruction will not be considered where appellant requested an instruction including the same matter. 5. TRIAL 296(4, 5) — INSTRUCTIONSTRIBUTORY NEGLIGENCE.

Action by Francis P. Williams, by his next friend, against the Springfield Gas & Electric Company. Judgment for plaintiff, and defendant appeals. Affirmed.

BLAIR, J. This cause was transferred here by the Springfield Court of Appeals (187 S. W. 556). The appeal is from a judgment for damages for injuries suffered by respondent, then nine years old, from contact with appellant's electric wires. These wires carried a powerful current, and were so placed that they passed through a tree which stood on or very near the line dividing a public alley from a building lot in Springfield. The tree was 30 or more feet high, and its lower branches were near the ground. It was a tree which children could and did climb easily. The insulation of the wires near and in the tree had been in bad condition for a year or more. Respondent was injured on May 9th. Where, as a result of injuries, one of plaintiff's arms was amputated below the elbow, his other arm almost useless, the fingers being burned and drawn, and he suffered burns on the body, and a verdict of only $7,500 was returned, the objection that misconduct of plaintiff's counsel affected the amount of recovery is untenable. 7.
