Mr. Ferris moved to reconsider the vote by which said bill was passed.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, as follows:

Mr. Ferris moved that said bill be recommitted to the committee on internal affairs of towns, counties and public highways with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Ferris, from the committee on internal affairs of towns, counties and public highways, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

The Assembly sent for concurrence a resolution, in the words following:

Resolved (if the Senate concur), That a respectful message be sent to the Governor, requesting the return to the Assembly of Assembly bill (No. 445, Rec. No. 121) entitled "An act to amend the Conservation Law, in relation to disposal of fur-bearing animals bred in captivity for purposes of propagation," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk return said resolution to the Assembly, with the message that the Senate has concurred in the passage of the same.

Mr. Nicoll, from the committee on civil service, to which was referred the Senate bill introduced by Mr. Nicoll (No. 703, Int. No. 657) entitled "An act to amend the Civil Service Law, in relation to retirement of officers and employees in the State civil service," reported in favor of the passage of the same with amendments, which report was agreed to, and said bill ordered reprinted and committed to the committee of the whole.

Mr. Baumes, from the committee on codes, to which was referred the Senate bill introduced by the Joint Legislative Committee on the Coordination of Civil and Criminal Practice Acts (No. 1681, Int. No. 1401) entitled "An act to amend the Code of Criminal Procedure, in relation to forfeited bail," reported in favor of the [SENATE JOURNAL]

passage of the same with amendments, which report was agreed to, and said bill ordered reprinted and committed to the committee of the whole.

Mr. Baumes, from the committee on codes, to which was referred the Senate bill introduced by the Joint Legislative Committee on the Coordination of Civil and Criminal Practice Acts (No. 1682, Int. No. 1402) entitled "An act to amend the Prison Law, in relation to indeterminate sentences," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Thompson (No. 849, Int. No. 775) entitled "An act to amend the Conservation Law, in relation to angling," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Thompson (No. 850, Int. No. 776) entitled "An act to amend the Conservation Law, in relation to costs in actions by the people," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thompson, from the committee on conservation, to which was referred the Senate bill introduced by Mr. Bouton (No. 1189, Int. No. 1052) entitled "An act to amend the Conservation Law, in relation to the open season for bear in Delaware, Greene and Ulster counties," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Thompson, from the committee on conservation, to which was referred the Assembly bill introduced by Mr. Pratt (No. 291, Rec. No. 124) entitled "An act to amend the Conservation Law, in relation to penalties," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Bouton, from the committee on insurance, to which was referred the Assembly bill introduced by Mr. Ambro (No. 1769, Rec. No. 289) entitled "An act to amend the Insurance Law, in relation to the conditions on which mutual automobile casualty insurance corporations may do business," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Truman, from the committee on labor and industry, to which was referred the Senate bill introduced by Mr. Truman (No. 1695, Int. No. 1413) entitled "An act to amend the Workmen's Compensation Law, in relation to compensation for percentage loss or loss of use of the eye," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hewitt, from the committee on finance, to which was

referred the Senate bill introduced by Mr. Gibbs (No. 1672, Int. No. 1392) entitled "An act making an appropriation for improvement of the Erie, Oswego and Champlain canals, under chapter one hundred and forty-seven of the Laws of nineteen hundred and three," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Hewitt, from the committee on finance, to which was referred the Senate bill introduced by Mr. Hickey (No. 1665, Int. No. 1384) entitled "An act to amend the Civil Service Law, in relation to the salary of the Civil Service Commissioners," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Mastick, from the committee on taxation and retrenchment, to which was referred the Senate bill introduced by Mr. Mastick (No. 437, Int. No. 429) entitled "An act to amend the Tax Law, in relation to the reassessment of property illegally assessed, reported in favor of the passage of the same with amendments, which report was agreed to, and said bill ordered reprinted and committed to the committee of the whole.

Mr. Mastick, from the committee on taxation and retrenchment, to which was referred the Senate bill introduced by Mr. Mastick (No. 1607, Int. No. 854) entitled "An act to amend the Tax Law, in relation to the taxation of the corporate franchises of corporations," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Mastick, from the committee on taxation and retrenchment, to which was referred the Senate bill introduced by Mr. Mastick (No. 1551, Int. No. 1329) entitled "An act to amend the Tax Law, in relation to the taxation of transfers by the exercise of powers of appointment," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Mastick, from the committee on taxation and retrenchment, to which was referred the Senate bill introduced by Mr. Truman (No. 959, Int. No. 862) entitled "An act to amend the Tax Law, in relation to special proceedings concerning special franchise tax assessments," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Mastick, from the committee on taxation and retrenchment, to which was referred the Senate bill introduced by Mr. Mastick (No. 1550, Int. No. 1328) entitled "An act to amend the Tax Law, in relation to reciprocity in taxation of transfers in estates of nonresidents," reported in favor of the passage of the same with amendments, which report was agreed to, and said bill ordered reprinted and committed to the committee of the whole.
