After some time spent therein, the President resumed the chair, and Mr. Kirkland, from said committee, reported in favor of the passage of the above named bills, the 2nd, 8th, 30th, 43rd, 71st, 74th and 79th with amendments, which report was agreed to, and said bills ordered to a third reading.

The Senate bill (No. 171, Int. No. 171) entitled "An act to amend the Village Law, in relation to public inspection and parade of the fire department," having been announced for third reading, Mr. Thompson moved that said bill be recommitted to the committee on affairs of villages.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Assembly returned the resolution by Mr. Mastick authoriz ing the printing of four thousand additional copies of the report of the Special Joint Committee on Taxation and Retrenchment, with a message that they have concurred in the passage of the

same.

Mr. Knight moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative. Whereupon, the Senate adjourned.

The Committee on Rules introduced a bill (Int. No. 1441) entitled "An act authorizing the creation of a State debt and making an appropriation for the acquisition of land for the Creedmoor Division of the Brooklyn State Hospital, which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on rules.

The Committee on Reorganization of State Departments introduced a bill (Int. No. 1442) entitled "An act to amend the State Departments Law by providing for a conservation department, and assigning to it certain functions of the State government, pursuant to article five of the Constitution," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on reorganization of State departments.

Mr. Byrne introduced a bill (Int. No. 1443) entitled "An act to amend the Railroad Law, in relation to the payments for the acquisition of lands, rights and easements for railroad crossing eliminations on county highways," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on rules.

Mr. Webb introduced a bill (Int. No. 1444) entitled "An act to confer jurisdiction on the Court of Claims to hear, audit and determine the claims of Samuel Silver, an infant, and of Isidor J. Silver, both of Poughkeepsie, New York, against the State of New York for personal injuries alleged to have been sustained by them, and for damages to personal property alleged to have been sustained by the said Isidor J. Silver at the hands of a member or members of the National Guard of the State of New York in, on, over and along Riverdale avenue, a public highway and thoroughfare, near Spuyten Duyvil parkway, in the city of New York and State of New York, and to render judgment therefor," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on rules.

Mr. J. F. Williams introduced a bill (Int. No. 1445) entitled "An act making an appropriation to pay Mary E. Fitzpatrick, sister of Elizabeth V. Fitzpatrick, a deceased school teacher, the pension she would have received had the said teacher lived until the eighth day of February, nineteen hundred and twenty-four,' which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on rules.

Mr. Knight moved that the committee of the whole be discharged from the consideration of Senate bill (No. 1667, Int. No. 1387) entitled "An act to amend the Highway Law, in relation to county aid for the construction and improvement of town highways and the designation of a competent person experienced in highway construction to take charge of and supervise the construction work on town highways constructed or improved by county aid when in the opinion of the county superintendent the town superintendent is not competent to properly perform the work," and that said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Knight moved that the committee of the whole be discharged from the consideration of Senate bill (No. 1607, Int. No. 854) entitled "An act to amend the Tax Law, in relation to

the taxation of the corporate franchises of corporations," and that said bill be amended, reprinted and recommitted to the committee of the whole.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Knight moved that the committee on general laws be discharged from the consideration of Senate bill (No. 1655, Int. No. 1290) entitled "An act to amend the General Business Law, in relation to the regulation of the practice of public accountancy and the authorization of public accountants to engage in such practice, and providing for appointment of board members by zones," and that said bill be amended, reprinted and recommitted to the committee on general laws.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

The Senate bill (No. 1439, Int. No. 818) entitled "An act to amend the Tax Law, in relation to deductions in computing net income with respect to income taxes," having been announced for third reading, Mr. Knight moved that said bill be recommitted to the committee on taxation and retrenchment with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Mastick, from the committee on taxation and retrenchment, reported said bill amended as directed, and the same was ordered reprinted and placed on the order of third reading.

No. 794) entitled "An act to amend the Tax Law, in relation to a review and readjustment of taxes by the State Tax Commission with reference to the personal income tax," having been announced for third reading, Mr. Knight moved that said bill be recommitted to the committee on taxation and retrenchment with instructions to said committee to amend and report the same forthwith to be reprinted as amended and restored to its place in the order of third reading.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.
