V. Because, it is respectfully submitted, His Honor erred in not deciding, as requested to do by the respondents, that the State has the right to regulate the freights to be charged by all companies in this State chartered by this State, or consolidated under the laws of this State with companies chartered by other States, notwithstanding any exemption from legislative control which might be claimed by such companies under their original charters, such consolidation having worked a dissolution of the original charters, and such exemption from legislative control having ceased when amendments to the original charters were made and accepted.
