*A dam was placed in the river in 1873 or 1874 and the water thus diverted into the Mitchell Slough used for irrigating all land covered by slough. The Moore Cut was dug to make possible the diversion of water into the Mitchell Slough without any dam.

The water for this ditch is diverted by means of a dam into a slough near the SW cor. of the SE of the NE of Section 27, T. 45 N, R. 64 E, and is then diverted from the slough into the constructed ditch near the NW cor. of the same forty.

About 202.52 acres of land lying between this ditch and the river from the point of diversion to the middle of Section 2, 46, 64 [Probably intended for T. 46 N, R. 64 E.] was irrigated in 1889. Since that date the ditch has gradually been extended until it covers all of the land which was irrigated at the Boar's Nets in 1874.

*Point of diversion located in the NESE of Sec. 10, T. 44 N, R. 63 E. Ditch is a natural channel. Water is applied to lands by means of check dams, laterals, natural channels, depressions.

Portions of the Old Channel Ditch were the main channel of Salmon River at the time the first diversion for irrigation was made on the Vineyard Ranch in 1876, when a dam and ditch were constructed in the SE of the SW of Sec. 9, T. 44 N, 63 E. This ditch became the main channel of the river, due to a large volume of water and excessive grade, since which time the old channel has been used to irrigate the lands described above by means of dams, laterals, natural channels, and depressions. Water is diverted to the Old Channel Ditch, in addition to the natural flow, through a short ditch on left or north bank of river, located above the dam, used also to divert water to the Harrell Salmon River Irrigation Ditch. This dam and ditch are situated in

No irrigation was done by means of ditches until 1894, after which date irrigation was done from both dams and ditches.

Of the above-described land 17.05 acres is grazing meadow, and 56.81 acres is hay meadow. $In the irrigation of the land described above, water is also applied to the lands by means of check dams, located in the main channel of Trout Creek and Warm Springs branch of Trout Creek, which was the method used prior to 1894. Subsequent to 1894 irrigation was done by means of both ditches and dams in the channel.

*Water for stock is carried by this ditch all the year round and has been continuously used since 1882. This ditch with its system of six main laterals furnishes water for the irrigation of the lands. Diversion is by means of a dam located in NE of the NE of Section 9, T. 43 N, R. 63 E. Length of main canal is approximately 5,300 feet. Aggregate length of laterals is approximately 9,100 feet.

Hot Creek is used as channel for irrigation, and the ditches are considered as laterals. $271.9 acres is named in the proof as the maximum acreage irrigated in any year, but no descriptions of the land are given.

All the water rises from springs located on property of the Vineyard Land and Stock Company. Fall Creek provides entirely for the slope drainage on the south, and Hot Creek carries but little water except from Hot Spring and other springs rising near the channel. Banks are low making it entirely feasible to use creek bed as irrigation channel. It is now difficult to determine the area first irrigated and the increased area during subsequent years. The beneficial use was progressive; the land in the flat was flooded directly from the channel, and later water was taken through laterals.
