Mr. Foote, from the committee on banks, to which was referred the Assembly bill entitled "An act to authorize the Rochester Bank to reduce its capital stock," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Ames, from the committee on commerce and navigation, to which was referred the bill entitled "An act to prevent issue of false receipts and bills of lading, and to punish fraudulent transfer of property by ship owners, carriers and others," reported a bill entitled “An act to amend the act entitled 'An act to prevent the issue of false receipts, and to punish fraudulent transfers of property by warehousemen, wharfingers and others,' passed April 17, 1858," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole. Mr. Scott, from the committee on the judiciary, to which was referred the bill entitled "An act in relation to the place of hearing and deciding appeals to the general term of the Supreme Court in certain cases," reported in writing adversely thereto, which report was agreed to.

Mr. Diven, from the committee on the judiciary, to which was referred the bill entitled "An act in relation to escheated lands and

providing for the descent of lands to aliens," reported adversely to said bill.

Mr. Laflin, from the committee on literature, to which was referred the petition of trustees of districts 4 and 11, in Newtown, Queens county, for a law to legalize the acts of the school commissioner of said county, reported a bill, entitled "An act to legalize the proceedings of the school commissioner and the trustees of the Union Free School, district number four, in the town of Newtown, county of Queens," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill, entitled "An act to authorize the Middletown and Unionville plankroad company to sell or mortgage their road,” reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Williams, from the committee on roads and bridges, to which was referred the bill entitled "An act to authorize the Middletown and Bloomingburgh plankroad company to sell or mortgage their road," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

Mr. Boardman, from the committee on Indian affairs, to which was referred the Assembly bill entitled "An act to enable the Shinecock tribe of Indians to exchange certain rights in land with the trustees of the proprietors of the common and undivided lands and marshes in the town of Southampton," reported in favor of the passage of the same, which report was agreed to, and said bill committed to the committee of the whole.

A message from the Assembly was received and read, requesting the concurrence of the Senate to the following entitled bills:

66 'An act to extend the charter of the Fire Department of the city of Albany," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the incorporation of cities and villages.

"An act legalizing the conveyance of lands held by James Kemp, an alien, of Niagara county," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to repeal an act passed March 23, 1857, chap. 154, Laws of 1857, entitled 'An act to amend an act entitled 'An act to incorporate the Long Causeway Turnpike Company,'” which was

read the first time, and by unanimous consent was also read the second time, and referred to the committee on roads and bridges.

Mr. Ely, from the select committee appointed at the last session of the Senate to investigate the health department of the city of New York, submitted a report in writing; which was laid on the table and ordered printed.

Mr. Paterson gave notice that he would at an early day ask leave to introduce a bill entitled "An act to amend the Revised Statutes relating to Courts of Oyer and Terminer."

Mr. Brandreth gave notice that he would at an early day ask leave to introduce a bill entitled "An act appropriating money for the relief of Brevet Brigadier General, Ward B. Burnett;" also, a bill entitled "An act to regulate the salary of the District Attorney of the county of Putnam;" also, a bill entitled "An act to incorporate the Raymond Collegiate Institute."

Mr. Halsted gave notice that he would at an early day ask leave to introduce a bill entitled "An act in relation to embezzlement by public officers."

Mr. Ely gave notice that he would at an early day ask leave to introduce a bill entitled "An act to amend an act entitled 'An act for the amendment of the law relative to principals and factors, or agents,' passed April 16, 1830."

Mr. Prosser gave notice that he would at an early day ask leave to introduce a bill entitled "An act concerning the navigation of

the canals, and the collection of tolls."

Mr. Mather gave notice that he would at an early day ask leave to introduce a bill entitled "An act to incorporate St. Joseph's asylum in the city of New York.”

In pursuance of previous notice, Mr. Diven asked and obtained leave to introduce a bill, entitled "An act to incorporate the Canandaigua Walton Club," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the internal affairs of towns and counties.

In pursuance of previous notice, Mr. John D. Willard asked and obtained leave to introduce a bill entitled “An act in relation to the village of Whitehall," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the incorporation of cities and villages.

In pursuance of previous notice, Mr. Johnson asked and obtained leave to introduce a bill entitled "An act for ascertaining by proper proof, the citizens who are entitled to the right of suffrage, and to prevent illegal voting," which was read the first time, and by unanimous consent was also read the second time.

The bill entitled, "An act to incorporate the Dime Savings Bank, in the city of Brooklyn," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:
