the bill entitled "An act to authorize the construction of enlarged locks upon the Erie and Oswego canals, and to provide the means to pay the expense thereof," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole. Mr. Parsons moved that said bill be made the special order Thursday next, immediately after the reading of the journal.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

On motion of Mr. Kline, the Senate adjourned.

The Senate met pursuant to adjournment. Prayer by Rev. Mr. Meredith.

The journal of yesterday was read and approved.

Mr. Lent presented a remonstrance against the passage of an act to amend an act entitled "An act relative to the sheriff certificates upon the sale of real estate;" which was read and referred to the committee on the judiciary.

Mr. Barnett presented a petition of 600 citizens of Homer, Cortland county, for authority to borrow money on the credit of said town to rebuild their academy; which was read and referred to the committee on finance.

Mr. Wolcott presented twelve petitions of citizens of New York, for the passage of a law securing increased facilities for the transaction of business connected with the canals, railroads and rivers of this State; which were read and referred to the committee on canals.

Mr. Low presented a petition of citizens and trustees, resident taxpayers of the village of Goshen, for the passage of Assembly bill No. 51; which was laid on the table.

Also, two remonstrances of citizens of New York city, against laying railroad tracks in Mercer street; which were read and referred to the committee on railroads.

Mr. Lent presented a remonstrance in regard to alteration of the charter of the city of Poughkeepsie; which was read and referred to the committee on municipal affairs.

Mr. Folger presented a petition of citizens of Seneca Falls, for a law relating to schools in that town; which was read and referred to the committee on literature.

Mr. E. Cornell presented a remonstrance against a city charter for Binghamton; which was read and referred to the committee on municipal affairs.

Mr. Platt presented a petition of citizens of Plattsburgh, for enlargement of Champlain canal; which was read and referred to the committee on canals.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the bill entitled "An act to incorporate the Ellsworth Hose Company No. 5, of the town of Castleton, in the county of Richmond," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. O'Donnell, from the committee on internal affairs of towns and

counties, to which was referred the bill entitled "An act to incorporate the Cataract Fire Engine Company No. 2, in the town of Castleton, county of Richmond," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the bill entitled "An act to amend the act to provide for the incorporation of religious societies, passed April 5, 1813," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act changing the name of the town of Port Crane, in the county of Broome, to Fenton," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to establish the number necessary to constitute a quorum in certain cases," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to fix the number necessary to form a quorum of the board of excise in and for the Metropolitan Police District of the State of New York, excepting and excluding the county of Westchester," and as amended, recommend its passage; said bill was committed to the committee of the whole.

On motion of Mr. Andrews and by unanimous consent, the rule was suspended and said bill read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to authorize the raising and repairing of a public highway in the town of Flushing, in the county of Queens,' passed April 4, 1865," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act confirming the election and official acts of Walter Tefft, as an assessor of the town of Moriah, in the county of Essex," reported in favor of the passage of the same, with amend

ments.

On motion of Mr. Platt and by unanimous consent, the rule was suspended, and said bill read a third time.

Mr. E. Mr. Lent gave notice that he would, at an early day, ask leave to introduce a bill in relation to the widening and improvement of certain west side cross streets in the city of New York.
