The defendant by his attorneys Griffiths & Kornicker, answering the complaint herein, alleges as follows:

FIRST.-He denies that he has any knowledge or information sufficient to form a belief as to the allegations contained in paragraph "First" of said complaint.

SECOND.-Denies each and every allegation contained in paragraph marked "Third" of said complaint, except that he admits that no part of said sum of $44.31 has been paid.

WHEREFORE defendant demands judgment dismissing the complaint with costs.

Summons issued with verified complaint returnable Nov. 12, 1920, at 9 o'clock A. M., at Court Room, Town Hall, in the Village and Town of Hempstead, Nassau County, N. Y.

Summons returned as having been personally 30 served on the defendant and a copy of the same left

with him on the 4th day of November, 1920, at the Town of Oyster Bay in said County by George S. Smith, Constable. Fees $1.85.

Pursuant to the annexed notice of appeal in the above entitled action which was served upon me the undersigned Justice of the Peace on the 2nd day of February, 1921, at which time the appellant's undertaking which is hereto annexed was delivered to me and the costs of the action included in the judgment, viz; $5.36 were paid to me together with the sum of $2.00 as the fee of the Justice making this return.

I do hereby respectfully return to the said County Court that the following are all the proceedings taken in the above entitled action including the evidence and the judgment entered therein, together with a brief statement of the amount and nature of the claims litigated by the parties; the summons
