Mr. Gibson moved that the same be postponed until to-morrow evening at 7 o'clock.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

Mr. Wolcott, offered the following resolution:

Resolved, That the bill entitled "An act to secure the navigation of the Oneida Lake canal, and to provide for the payment of the expense thereof," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof, as follows:

On motion of Mr. La Bau and by unanimous consent, the rules were suspended, and bill entitled "An act to amend chapter 819, Laws of 1866, entitled 'An act to incorporate the village of New Brighton,” was recommitted to the committee on municipal affairs, with power to report complete.

Mr. T. Murphy moved to take from the table the bill entitled "An act to amend an act entitled 'An act to authorize tho construction of a railway and tracks in the towns of West Farms and Morrisania."

The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the affimative. Said bill having been announced for a third reading.

On motion of Mr. T. Murphy, said bill was amended as follows: Section 2, line 7, strike out the words "Southern Westchester Turnpike or" and add to same section the words "The cars on said railroad hereby extended, shall only be drawn by horses, or other animals, unless otherwise assented to in writing, by a majority of the owners of real estate on said extensions."

Said bill, as amended, was then read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk deliver said bill to the Assembly, and request their concurrence therein.

Mr. Andrews moved that the bill entitled "An act in relation to the compensation of the officers and clerks in the bureau for the collection

of taxes in the department of finance, of the city and county of New York," be referred to the first committee of the whole, not full.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative, two-thirds of all the Senators present voting in favor thereof.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to incorporate the German Mechanics' and Benevolent Association of the village of Lyons, in the county of Wayne."

"An act in relation to the compensation of the officers and clerks in the bureau for the collection of taxes in the department of finance, of the city and county of New York."

"An act to secure the navigation of the Oneida Lake canal, and to provide for the payment of the expenses thereof."

After some time spent therein, the President resumed the chair, and Mr. Pierson, from said committee, reported in favor of the passage of the first named bill, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Pierson, from the same committee, reported in favor of the passage of the second named bill, without amendment, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Pierson, from the same committee, reported progress on the last named bill, and asked and obtained leave to sit again.

The President presented the following communication:

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend an act entitled 'An act to incorporate the Rochester Waterworks Company,' passed April 16, 1852, to increase the capital stock, and authorizing the city of Rochester to aid in construction of said works, pursuant to section 26 of said act," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to enable Samuel V. Haight, of the town of Root, Montgomery county, to set apart a plot of ground for a family grave-yard, and to secure the same forever from sale for taxes, or from alienation by deed or otherwise," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on insurance, to which was referred the bill entitled "An act to amend an act entitled 'An act to provide for the incorporation of insurance companies,' passed April 10, 1849," with power to report complete, reported that they have made some amendments thereto, and amended the title by adding thereto the following words: "and to extend the benefit of such amendment to companies organized under special charters," and as amended, report the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on insurance, to which was referred the bill entitled "An act to amend the charter of the National Travelers Insurance Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Folger, from the committee on insurance, to which was referred the Assembly bill entitled "An act to amend section 4 of the act entitled 'An act to authorize the formation of town insurance companies,' passed April 17, 1857," reported that they have made some amendments thereto, and amended the title so as to read as follows: "An act to confer power upon such insurance companies now in existence as were organized under an act entitled 'An act to authorize the formation of town insurance companies,' passed April 17, 1857," and as amended, recommend its passage; said bill was committed to the committee of the whole,
