Mr. Folger, moved to take from the table the motion to recommit to the committee on the judiciary the bill entitled "An act to provide for repaying to various banks and banking associations in the county of Ulster, taxes unlawfully assessed in the years 1861, 1862, 1863 and 1864, and paid or collected on that portion of their capital stock invested in securities of the United States, by law exempt from taxation," with instructions to report a general bill upon that subject.

The President put the question whether the Senate would agree to said motion to take from the table, and it was decided in the affirmative.

On motion of Mr. Wolcott and by unanimous consent, the rules were suspended, and the bill entitled "An act for the relief of George Pettys, and to release to the heirs-at-law of August Pequinot, late of the town of Palermo, and county of Oswego, deceased, the right, title and interest of the State of New York, in and to certain surplus moneys," was recommitted to the committee on the judiciary, with power to report complete.

The Assembly returned the bill entitled "An act to amend chapter 236 of the Laws of 1859, in relation to the redemption of the notes of closing Banks," with a message that they had passed the same, with the following amendments:

Section 1, line 7, engrossed bill, strike out the word "bank" and insert "banking association or individual banker."

Same section, line 9, after the word "annum" insert "and banking associations or individual bankers, having made deposits of cash under existing laws, may in the discretion of the Superintendent of the Banking Department avail themselves of the provisions of this act"

Section 2, line 3, engrossed bill, strike out the word "bank" and insert banking association or individual banker."

Same section, line 5, strike out the word "bank" first occurring, and insert "banking association or individual banker."

Mr. Wolcott moved to concur in said amendments.

Mr. Lent, from the committee on municipal affairs, to which was referred the bill entitled "An act to alter the map or plan of the city of New York, by discontinuing Hamilton square, laid down on the said map or plan, as lies between the Fourth and Fifth avenues and Sixty-sixth and Sixty-eighth streets, in said city," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. T. Murphy and by unanimous consent, the rules were suspended, and the bill entitled "An act to alter the map or plan of certain portions of the city of New York, and for laying out and improvement of the same," was recommitted to the committee on municipal affairs, with power to report complete.

Mr. Gibson presented two petitions of citizens of Washington county, for repeal of law to repair canals by contract; which were read and referred to the committee on canals.

Also, a petition of citizens of Sandy Hill, for law to aid in the construction of railroads; which was read and referred to the committee on railroads.

The President presented the report of the comptroller of the city of New York, containing statement of all unexpended appropriations pur

suant to chapter 646 of the Laws of 1865; which was laid on the table and ordered printed.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to amend an act entitled 'An act to amend the several statutes in relation to laying out public roads and the alteration thereof, in the towns of North Castle, Bedford and Lewisborough, in the county of Westchester,' passed April 12th, 1859," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.
