Mr. Folger, from the committee on the judiciary, to which was referred the bill entitled "An act to amend an act entitled 'An act to authorize the North American Life Insurance Company, to make special deposits of securities in the Insurance Department,' passed April 14, 1866," and the bill entitled "An act in relation to the Albany Life Insurance and Annuity Company," and the bill entitled 'An act to authorize the Excelsior Life Insurance Company to make special deposits of securities in the Iusurance Department,'" reported that they have come to an adverse conclusion thereto, but have directed their chairman to report a general bill entitled "An act to authorize life insurance companies to make special deposits of securities in the Insurance Department," as a substitute therefor; which report was agreed to and said bill was committed to the committee of the whole.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to amend chapter 61, Laws of 1856, entitled 'An act to amend an act entitled 'An act to provide for taking acknowledgments of deeds and other written instruments, by persons residing out of the State of New York,'" passed March 28th, 1856," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

The Assembly sent for concurrence, the following resolution:

IN ASSEMBLY, April 2, 1867. Whereas, it is expedient that the great public charities should be under the immediate control and management of the State; therefore,

Resolved (if the Senate concur), That the Attorney General and Superintendent of Public Instruction be directed to consult with the board of directors of the New York Institution for the Instruction of the Deaf and Dumb, for the purpose of ascertaining the terms upon which they will transfer the property and control of said institution to the State of New York.

Resolved (if the Senate concur), That the Attorney General and Superintendent of Public Instruction report to the Legislature, as early as is practicable, the result of their consultation with said board of education. By order, LUTHER CALDWELL, Clerk.

Mr. Folger, from the committee on insurance, to which was referred the Assembly bill entitled "An act to amend 'An act to extend and amend the acts entitled 'An act to incorporate the Westchester County Mutual Insurance Company,' passed March 14, 1837,' passed March 7, 1857," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Barnett, from the committee on charitable and religious societies, to which was referred the bill entitled "An act to incorporate the Deaconesses Institution of the Evangelical Lutheran Church," reported in favor of the passage of the same, with amendments, and said bill was committed to the committee of the whole.

The Assembly returned the bill entitled "An act in relation to fare on the New York Central Railroad," with a message that they have passed the same with the following amendments:

Strike out section two, and insert in lieu thereof the following:

Section 2. It shall be the duty of every railroad company in this State, to carry freight offered to it from this State, with as much dispatch as possible, and all freight offered at any freight station of any such company for shipment on its road, to the extent of the capacity of the company's warehouses at the place where offered, shall be sent therefrom within ten days after the receipt of such freight, unless prevented by accident, the direction of the consignce or unavoidable causes, and no discriminations in regard to dispatch shall be made in favor of freight from other States."

Amend the title so as to read "An act regulating the carrying of pas

sengers and property on the New York Central and other railroads of this State."

Mr. Pierson moved to concur in said amendments.

The President put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, as follows:

The journal of yesterday was read and approved.

Mr. Low presented a remonstrance of tax payers, property owners and others, citizens of Newburgh, against the proposed act for laying out streets in said city; which was read and referred to the committee on municipal affairs.

Mr. Platt presented two remonstrances of E. H. Rosekrans and others, owners of land in Northern New York, against the proposed changes in the act to lay out a road from Johnsburgh to the Carthage road, near Long Lake; which was read and referred to the committee of the whole.

Mr. Low presented a petition for the passage of an amendment to the act entitled "An act to authorize certain towns in the counties of Ulster and Orange, to issue bonds and take stock in the Wallkill Valley Railroad, passed May 9, 1866;" which was read and referred to the committee on railroads.

Mr. Lent presented a petition of citizens of New York, for paving Hudson street; which was read and referred to the committee on municipal affairs.

Mr. Chambers presented four remonstrances against the act to amend the charters of Rondout and Kingston as to bounds thereof; which was read and referred to the committee of the whole.

Mr. Andrews, from the committee on municipal affairs, to which was referred the bill entitled "An act to amend 'An act to amend and consolidate the several acts relating to the village of Ilion,' passed March 8, 1865," reported that they have amended the title thereof so as to read as follows: "An act to amend an act entitled 'An act to amend and consolidate the several acts relating to the village of Ilion,' passed March 8, 1865, and to confirm the official acts of the police justice of said village," and as amended, recommend its passage.

On motion of Mr. Andrews and by unanimous consent, the rule was suspended, and said bill recommitted to the committee to report complete.

Mr. Andrews, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act to amend and consolidate the several acts relating to the village of Hornellsville," reported in favor of the passage of the same, with amendments.

On motion of Mr. Pierson and by unanimous consent, the rule was suspended, and said bill recommitted to the committee to report complete.

Mr. Humphrey, from the committee on roads and bridges, to which was referred the Assembly bill entitled "An act to amend the act entitled 'An act for a free bridge over the Mohawk river,' passed April 6th, 1859," reported in favor of the passage of the same.

On motion of Mr. Pierson and by unanimous consent, the rule was suspended, and said bill recommitted to the committee to report complete.
