The Assembly bill entitled "An act to amend an act entitled 'An act amending the act for the supply of water for the State Lunatic Asylum from the Chenango canal,' passed April 18, 1859," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in the passage of the same, without amendment.

The Assembly bill entitled "An act to construct a highway from the town of Keene, in Essex county, to the State road, in the town of North Hudson, in said county," was read a third time.

The President put the question whether the Senate would agree to the final passage of said bill, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Mr. Godard, from the committee on claims, to which was referred the petition of John E. Westlake and others, for relief, reported by bill entitled "An act for the construction of a ditch in the town of Horseheads adjacent to the Chemung canal," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Godard, from a majority of the committee on claims, to which was referred the Assembly bill entitled "An act for the relief of Clinton Stephens," reported in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Gibson stated his dissent from the report.

The Senate then went into executive session, and after some time spent therein, the doors were opened and legislative business resumed. Mr. Godard, from a majority of the committee on claims, to which was referred the Assembly bill entitled "An act for the relief of the legal representatives of Walter Bissell, deceased," reported in writing, and in favor of the passage of the same, and said bill was committed to the committee of the whole.

Mr. Gibson, from the committee on the judiciary, to which was referred the bill entitled "An act to release to Robert Jones, as trustee and executor, the title and interest of the people of this State in and to certain

lands in the city of Utica, Oneida county, and empowering him to convey the same," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.

On motion of Mr. Wilbor and by unanimous consent, the rules were suspended, and the following entitled Assembly bills recommitted to the committee on the judiciary, with power to report complete:

"An act to amend an act passed February 11, 1860, entitled 'An act in relation to the cutting of ice in the Hudson river,' providing addi tional safeguards for travelers and teams, and conferring jurisdiction over offenses mentioned in said act."

"An act to release the title of the people of the State of New York, in and to certain real estate, to Mary Daley, Norah Daley, Eliza Daley and Delia Daley."

"An act to amend 'An act in relation to draining certain lands in the town of Fishkill, in the county of Dutchess,' passed April 24, 1866."

On motion of Mr. Andrews and by unanimous consent, the rule was suspended, and the Assembly bill entitled "An act to authorize the construction of a railroad from the village of Forestport to Bellingertown, and a branch road by way of Grant's Mills to the west line of Herkimer county," was recommitted to the committee on railroads, with power to report complete.

Mr. Lent, from the committee on municipal affairs, to which was referred the communication of the comptroller of the city of New York, reported by bill entitled "An act to enable the board of supervisors of the county of New York to raise money by tax for certain county purposes," which was read the first time, and by unanimous consent was also read the second time, and committed to the committee of the whole.

Mr. Lent, from the committee on municipal affairs, to which was referred the Assembly bill entitled "An act in relation to the collection of arrears of personal taxes in the city of New York," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

On motion of Mr. Collins and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend chapter 37 of the Laws of 1848, entitled "An act to authorize the formation of gaslight companies,"" was recommitted to the committee on manufactures, with power to report complete.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

"An act to authorize the consolidation of certain railroad corporations in the city of New York."

"An act to amend chapter 210 of the Laws of 1861, entitled 'An act to amend the Revised Statutes, in relation to trials by jury.'"

"An act to amend an act entitled 'An act to provide for the collection of agricultural statistics,' passed April 17, 1862."

After some time spent therein, the President resumed the chair, and Mr. Lent, from said committee, reported progress on the first named bill, and asked and obtained leave to sit again.

Mr. Lent, from the same committee, reported in favor of the passage of the second named bill, with amendments, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Lent, from the same committee, reported in favor of the passage of the last named bill, without amendment, which report was agreed to and said bill ordered engrossed for a third reading.

Mr. Chambers moved that the Senate adjourn.

The Senate again resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the bills entitled as follows:

Assembly, "An act to amend an act entitled 'An act to incorporate the president, managers and company of the Delaware and Hudson Canal Company,' passed April 23, 1823."

"An act to authorize the construction and maintenance of a bridge over the Champlain canal, in the town of Fort Ann, in the county of Washington."

After some time spent therein, the President resumed the chair, and Mr. Chambers, from said committee, reported progress on the first named bill, and asked and obtained leave to sit again.

On motion of Mr. Sutherland and by unanimous consent, the rules were

suspended, and the Assembly bill entitled "An act to release and convey the interest of the people of the State of New York of, in and to certain real estate situated in the village of Yonkers, county of Westchester, to Charlotte Probst (formerly Charlotte Murphy)," was recommitted to the committee on the judiciary, with power to report complete.

The Assembly sent for concurrence the bills entitled as follows:

"An act to revive an act entitled 'An act to incorporate the Foote Library and Historical Society in Jamestown, New York," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on literature.

"An act to amend the statutes in reference to the collection of taxes in the county of Onondaga," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on the judiciary.

"An act to amend the charter of the village of Avon," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on municipal affairs.

"An act to facilitate the construction of the Dunkirk, Warren and Pittsburgh Railroad, and to authorize towns in the county of Chautauqua to subscribe to the capital stock of said company," which was read the first time, and by unanimous consent was also read the second time, and referred to the committee on railroads.

Mr. White, from the committee on literature, to which was referred the bill entitled "An act amendatory of and in addition to the act entitled 'An act relative to the incorporation of colleges aud academies,' passed April 12, 1853," with power to report complete, reported the same complete, which report was agreed to and said bill ordered engrossed for a third reading.
