and additions to the force provided for by this section, shall be appointed and determined only on a unanimous affirmative vote of the board duly recorded, all the members being present."

Mr. Lent moved that the Senate concur in said amendments.

The President then put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendments.

On motion of Mr. White and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to amend section 6 of article 1st, title 2d, chapter 13, part 1st of the Revised Statutes, entitled 'Of the place in which property is to be assessed,'" was recommitted to the committee on the judiciary, with power to report complete.

Mr. Godard moved that the Senate do now adjourn.

The President put the question whether the Senate would agree to said motion, and it was decided in the negative.

The Senate then resolved itself into a committee of the whole, and proceeded to the consideration of general orders, being the Assembly bill entitled as follows:

"An act providing for relief against illegal taxation."

After some time spent therein, the President resumed the chair, and Mr. Pierson, from said committee, reported progress on said named bill and asked and obtained leave to sit again.

On motion of Mr. Sutherland and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to incorporate the Peekskill Iron Moulders' Association," was recommitted to the committee on the judiciary, with power to report complete.

The Assembly returned the following entitled bills, with a message that they had concurred in the passage of the same, without amendment, to wit:

"An act to amend the act entitled 'An act to authorize William Beard and others, to erect, construct, build and maintain sea walls or breakwater piers, docks, wharves, bulkheads, piers and warehouses, and a basin for commercial uses in front of their lands in the Twelfth ward of the city of Brooklyn,' passed April 30, 1866."

"An act to incorporate the Albany Iron Manufacturing Company." "An act to increase the rate of tolls on the Dansville and Wayland Plankroad Company."

"An act to amend chapter 600 of the Laws of 1865, passed April 28, 1865, entitled 'An act to amend an act entitled 'An act in relation to the compensation of the several officers of State prisons,' passed April 23, 1864.'"

The Assembly returned the following entitled bill, with a message that they had concurred in the report of the committee of conference thereon, to wit:

"An act to authorize certain towns in the counties of Oneida, Madison and Chenango, to issue bonds and take stock in any company now organized or that may hereafter be organized, within two years after the passage of this act, for the purpose of building a railroad from Utica through Clinton, Oneida county, to Sherburne, Chenango county."

Ordered, That the Clerk return said bill to the Assembly.

The Assembly returned the following entitled bill, with a message that they had concurred in the amendments of the Senate thereto: "An act to incorporate the Warehouse Loan Company."

"An act to authorize the Fayetteville and Syracuse Plankroad Company to construct a railroad on and near its present route."

"An act to incorporate the New York and African Transportation Company."

"An act to authorize the consolidation of the Maspeth Avenue and Toll Bridge Company and the Williamsburgh and Newtown Railroad Company into one corporation."

"An act in relation to a certain highway, and highway taxes in the county of Hamilton."

"An act to authorize the extension of Central Road or Avenue, in the county of Westchester, from its terminus at or near Wood Lawn Cemetery, in the town of Yonkers, to a point at or near the village of White Plains."

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act for the incorporation of the Harmonic Social Club of the city of New York," with power to report complete,

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to authorize the overseers of the poor of the town of Skaneateles to receive certain bequests to them under and by the last will and testament of David Hall, deceased, and requiring them to give security therefor," reported in favor of the passage of the same, with amendments.
