That they agree to the amendments of the Assembly, except that they recommend the rejection of sections 3 and 6 of said amendments, and that said sections be stricken out.

The President put the question whether the Senate would agree to the report of the conference committee, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have agreed to the report of the committee of conference.

The Assembly returned the bill entitled "An act to provide for making indices of the deeds, mortgages, writings, documents, maps and so forth, of record in the county of Richmond, and for the payment of the cost and expenses thereof, and of the books and materials required for the same," with a message that they had passed the same, with the following amend

ment:

Strike out section 3, and insert in lieu thereof the following:

"§ 3. The board of supervisors are also authorized to furnish to said county clerk, at the cost of said county, all books, papers and materials necessary in their judgment to enable him to perform the services in this act provided for."

Mr. La Bau moved to concur in said amendment of the Assembly, with the further following amendment:

Strike out section 1 of engrossed bill, and insert in lieu thereof the following:

"§ 1. The supervisors of the county of Richmond are hereby authorized and directed to contract with the county clerk of said county to make general vowelized indices of all deeds and mortgages now of record in the office of said clerk, and of all other writings, papers and documents, and proceedings on file or of record in said office, of which indices are now kept."

The President put the question whether the Senate would agree to said motion to concur, and it was decided in the affirmative, a majority of all the members elected to the Senate voting in favor thereof, and three-fifths of said members being present, as follows:

Collins Ordered, That the Clerk return said bill to the Assembly, with a message informing that the Senate have concurred in their amendment thereto with a further amendment.

On motion of Mr. Sutherland and by unanimous consent, the rules were suspended, and the Assembly bill entitled "An act to provide for draining certain swamp and bog lands on the Maway creek, in the town of Ramapo, Rockland county," was recommitted to the committee on the judiciary, with power to report complete.

Also, the Assembly bill entitled "An act to amend an act entitled 'An act for the collection of taxes in the towns of Morrisania and West Farms, in the county of Westchester,' passed April 21st, 1862" was recomitted to the commtittee on internal affairs of towns and counties, with power to report complete.

The President appointed as a committee of conference upon the Assembly bill entitled "An act to amend an act to facilitate the construction of the Ithaca and Towanda Railroad," Messrs. E. Cornell, Williams and Low.

Mr. La Bau, from a majority of the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate the Albany Club of the city of Albany," reported in favor of the passage of the same.

On motion of Mr. Collins and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate the Lower California Company," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to provide for the drainage of the low lands in the west part of the town of Newfane, and the south-east part of the town of Wilson, in the county of Niagara," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to incorporate the Rochester Iron Moulders' Association," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act for the incorporation of co-operative and industrial unions," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. O'Donnell, from the committee on internal affairs of towns and counties, to which was referred the Assembly bill entitled "An act for the preservation of trout in certain brooks in the county of Clinton," reported in favor of the passage of the same.

On motion of Mr. Platt and by unanimous consent, the rules were suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act authorizing the clerk of the county of Queens to record and index the notices of pendency of action on file in his office," with power to report complete, reported the same complete, which report was agreed to and said bill ordered to a third reading.

Mr. Folger, from the committee on the judiciary, to which was referred the Assembly bill entitled "An act to release to Owen Keenan certain real estate escheated to the people of this State," reported in favor of the passage of the same.

On motion of Mr. H. C. Murphy and by unanimous consent, the rule was suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Andrews, from the committee on municipal affairs, to which was

referred the Assembly bill entitled "An act for the relief of John Underwood, and to provide for the payment of extra work in building a bridge in the village of Penn Yan," reported in favor of the passage of the same, with amendments.

On motion of Mr. Folger and by unanimous consent, the rules were suspended, and said bill recommitted to the committee, with power to report complete.

Mr. Sessions offered the following resolution:

Resolved, That the Auditor of the Canal Department be requested to report to the Senate the amount of money raised for the extension of the Chenango canal, and the amount of the extension fund on hand the first day of January, 1867.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Mr. La Bau, from the committee on engrossed bills, reported as correctly re-engrossed, the bills entitled as follows:

"An act to charter the village of Randolph, Cattaraugus county." "An act to authorize the rebuilding and maintenance of a bridge over the Chemung canal, in the town of Elmira, and to abandon bridge No. 8." "An act to confirm the appropriation and sale of certain stone, timber and materials on the Cattaraugus reservation, made by the Seneca Nation of Indians in council, for the purpose of constructing a bridge across the Cattaraugus creek at Versailles, on such reservation, under provisions of chapter 69 of the Laws of 1866."

"An act to legalize the proceedings of the annual town meeting of the town of De Kalb, in the county of St. Lawrence, held on the 12th day of February, 1867, in relation to the appropriation and disbursement of certain surplus money which was paid over to the supervisor of said town by the late recruiting committee of said town of De Kalb."

"An act for the protection of persons traveling upon Fourth avenue, in the city of New York."
